Commercial litigation finance–in the United States, at least– is still in its relative infancy. While the practice remains controversial to some, it cannot be denied that litigation financing is steadily gaining acceptance as a mainstream feature of the litigation landscape. Increasingly, both claimholders and lawyers are looking to employ external capital to share the financial risk and operational burden of pursuing complex litigation. According to one recent study, the number of in-house counsel and CFOs who have used litigation finance more than doubled between 2013 and 2014, and shot up by 36% among outside litigators. The same study found that the vast majority of Biglaw litigators expect the use of litigation finance to continue to increase in the next 18 months. More than half of that group reported (wistfully?) they have previously had a case that would have benefited from outside financing.
Though awareness is on the upswing, the reputation and track records of litigation finance firms are largely obscure to most in the profession. ATL is looking to get a sense of our audience’s perception of the major players in this emerging market.
