Business Trial Lawyers To Examine Litigation Finance

As litigation finance has become increasingly prevalent in the United States, it has captured the attention of both companies and their corporate lawyers. These organizations are using litigation finance a broad array of commercial disputes, including breach of contract, trade secret misappropriation, business torts, breach of fiduciary duty, fraud, patent, and antitrust claims.

On Friday, Oct. 2, business trial lawyers and judges from across the state of California will have the opportunity to discuss at the ins and outs of litigation finance and how it’s changing the dynamics of litigation against and between businesses as part of a four-day conference put on by the Association of Business Trial Lawyers (ABTL), a California-based organization serving as a forum for the discussion well as promoting communication between the bench and bar.

The panel — which includes representatives of litigation finance firms Lake Whillans, Bentham and Burford, as well as judges and lawyers — will tackle questions ranging from how funding changes initial case investigation, to the kinds of due diligence funders perform prior to agreeing to fund a case, to how funding impacts all the stages of a case (does a case move faster or slower, does it increase or decrease odds of going to trial, etc.). They’ll also look at broader social questions concerning the impact of litigation finance on the justice system.
