Supreme Court Justice Says He'll Probably Retire... At Some Point

Will President Obama be able to appoint another Supreme Court justice before his second term is up?

I guess at some point I will retire. You want to know when. I don’t know. I will figure it out at some point. How do I know? Normally it is a personal decision… and I will make it personally at some point. As long as I am doing my job.

— Justice Stephen Breyer, responding to questions asked by Tony Mauro of the National Law Journal about the likelihood of his imminent retirement, and whether his retirement will depend on who is serving as president.

(Set your DVRs, because Justice Breyer will be appearing as a guest on The Late Show with Stephen Colbert tonight. Justice Breyer intends to speak about the role of foreign law in American courts because unlike The Colbert Report, it’s a “serious news show.”)
