Dewey Mistrial!

The Dewey trial is over... for now.

It took 76 days, but the Dewey trial is over. The former Dewey & LeBoeuf braintrust may have been woefully incompetent, but the government couldn’t convince this jury that they were criminals. And with that the interminably long deliberations that resulted in acquittals on 58 counts and ceaseless disagreement on the remaining 93 counts including big ticket items of grand larceny, scheme to defraud, and securities fraud comes to an end.

Per the Law 360 liveblog just minutes ago:

The note reads: “We are indeed hopelessly deadlocked. Further instructions will not help us to reach a verdict.”

As for what’s next? Judge Stolz has sent the jurors home and told the parties to take a breather:

The jury leaves. Judge Stolz says the parties should set a status conference to discuss the pending motions to dismiss the case. The judge sets a date of November 16 to reconvene and assess the case. There’s no immediate word if the Manhattan DA will try the execs again.

The Manhattan DA’s office is nothing if not relentless in the face of defeat, but — forgive me for this — Dewey think they’ll march down this road again.
