Does The Equal Protection Clause Forbid Racial Preferences In State University Admissions?

Consider this your preview of the Fisher redux.

Before we have to sit through the rehash of Abigail Fisher’s inability to test well enough to go to the University of Texas, we can enjoy watching some smart people debate about affirmative action.

Tonight’s debate put on by Intelligence Squared U.S. pits Roger Clegg, the President & General Counsel of the Center for Equal Opportunity, and Stuart Taylor Jr., Nonresident Fellow at Brookings & Co-Author (with UCLA Law Professor Richard Sander) of Mismatch (affiliate link), against Deborah Archer, the Director of the Racial Justice Project and a Professor at New York Law School, and Dean Erwin Chemerinsky of the University of California-Irvine School of Law (and two-time top 5 debater at the National Debate Tournament). Clegg and Taylor will argue that the Constitution bars affirmative action in education, while Archer and Chemerinsky will defend affirmative action.

The debate kicks off at 6:45 p.m. Eastern and you can watch the whole affair below. And don’t forget to cast your votes before and after the debate.
