Is Continued Prosecution Of The Dewey Defendants 'Un-American'?

They've already been tried for these crimes once. Is it fair for the prosecutors to get a second bite at the apple?

There comes a point where it’s fundamentally not fair and it’s un-American.

Andrew Frisch, counsel to Dewey & LeBoeuf’s former chief financial officer, Joel Sanders, commenting on the charges his client is still facing. After a mistrial in October 2015, Sanders was offered a plea deal of one to three years in prison, while Stephen DiCarmine, the firm’s former executive director, was offered a plea deal of 500 hours of community service but no jail time. Neither Sanders nor DiCarmine have accepted the plea deals they’ve been offered, and a retrial has tentatively been set for September 12, 2016. Earlier today, Steven Davis, the firm’s former chairman, accepted a plea deal barring him from practicing law in New York for five years (though he’ll still be able to practice in other states or abroad).
