Hint: He is not the only Supreme Court nominee from that same Biglaw shop to experience… difficulties getting confirmed to a SCOTUS position by the Senate. Abe Fortas was the first Jewish former partner of the same law firm to have been nominated by a second-term Democratic President for a position on the Supreme Court. (Already on the Court, President Johnson nominated Fortas to succeed Earl Warren as Chief Justice in 1969. Following a failed attempt to break cloture on his nomination, Fortas withdrew his nomination. He resigned as Justice in 1969.) The firm has undergone a name change since Fortas’s day, but it is still the same firm.
