This Law Professor Knows How To Handle A Trump Presidency: Impeachment

Donald Trump with FingersLet’s assume the wheels fall off this experiment in democracy we call “America” and Donald Trump becomes President of the United States. What’ll we do then? Sure, some people want to move to Canada, but what will happen to the rank and file — those who need their jobs to survive — in a world where Trump is president?

Maybe they don’t have to worry… if Trump is impeached.

Utah law professor Christopher Lewis Peterson investigates the question of whether the allegations surrounding Trump University would be sufficient to immediately impeach Donald Trump, if he were elected.

This essay provides a legal analysis of whether Trump’s alleged behavior would, if proven, rise to the level of impeachable offenses under the presidential impeachment clause of the United States Constitution. This essay begins with a summary of the evidence assembled in the three pending Trump University civil lawsuits. Next, it describes the legal claims involved in each matter. Then, this essay summarizes the applicable law of presidential impeachment under the United States Constitution and analyzes whether Trump’s actions in connection with Trump University are impeachable offenses. Finally, I offer concluding thoughts, considering in particular the policy implications of a major presidential campaign with simultaneously pending legal complaints of fraud and racketeering.

This also assumes Democrats somehow manage to take back the House of Representatives, which may only be a pipe dream at this point.

But, man, it is fun to dream.
