Children singing christmas carolsBefore we get started here, I have a confession to make: I love Christmas music. I play it before Thanksgiving and I DON’T CARE. Sometimes I just need a little Christmas. And once Jack Frost is nipping at your nose, forget it — all bets are off.

You see, for some people, the music is not just for when there’ll be parties for hosting, but for every day, all day, during the holiday season. While others are different — on every street corner they don’t hear Christmas cheer but rather traffic snarling by. It doesn’t make them a nasty, wasty skunk, just different. Or an atheist.

But lend me your comb — I need to go through the details of a new lawsuit that’s making waves in New York City, and in the interest of impartiality I’ll try to put aside my love of the season — I won’t even wish for snow.

A lawyer, Nick Wilder, is suing a neighbor, Lisa Maria Falcone — wife of hedge fund boss Philip Falcone — with a penchant for sharing her love of Christmas music with the city. As reported by The Hive:

Lisa Maria Falcone, is blasting holiday music out of speakers set up as part of her Christmas display outside her 25,725-square-foot, 27-room mansion on East 67th Street. “It’s not like she plays it a half-hour every day,” he [Wilder] said. “It’s on from 7 a.m. to midnight. I like a Christmas song on Christmas Day. But I’m tired of hearing ‘Jingle Bells’ like 700 or 800 times a day.” So, naturally, he’s attempting to rob her of her Christmas cheer, suing her to shut the damn music off.

The lawsuit comes from the glorious kingdom of the Upper East Side, where people aren’t known for being jolly happy souls but rather as the chic and wealthy backdrop of Gossip Girl with cars big as bars. As Wilder notes, you never see him kick up a fuss about small inconveniences, but the constant, loud music pushed him over the line. Remember, she didn’t ask, “Shall I play for you Christmas music?” No, she went ahead and assumed her holiday cheer was welcomed by all within earshot.

And now she has a lawsuit on her hands. Falcone is also known for her outrageous and scary Halloween tableau, so it’d seem Wilder knows his neighbor’s habits and is looking to save himself from tears with the suit. The question remains will she face unafraid the plans — and lawsuit — her neighbor has made?
