I feel like we have this story every fall. Every year, new 1Ls get to law school campuses and invariably, some of them quickly look around to see which boots are most in need of licking. The first few weeks they kiss so much faculty ass they look like they’re applying for tenure. And right around now, they start looking for fellow students to suck up to.
Well, there’s a way to suck up to fellow students, and usually kissing butt requires you to be in the same room as your betters. Cold, unsolicited emailing — while fine for general networking — is almost always the wrong way to approach your peers. We’ve explained this to you before.

I can’t believe that we have to talk about this idiotic Catholic University “controversy” of adopting same-sex dorms, but Supreme Court Justice Antonin Scalia talked about it, so now everybody has to talk about it. We can’t get Scalia to talk about executing prisoners in Georgia, and he tells us to “get over it” when we ask him about his role in usurping the power of the American people and appointing a President of the United States, but the smartest justice on the Court has an opinion on the dumbass potential lawsuit by George Washington University law professor John Banzhaf about same-sex dorms.
Speaking at Duquesne University School of Law, the Pittsburgh Tribune-Review (gavel bang: ABA Journal) reports that Scalia said: “I hope this place will not yield — as some Catholic institutions have — to this politically correct insistence upon suppression of moral judgment, to this distorted view of what diversity in America means.” Apparently, this was Scalia’s way of supporting Catholic University’s same-sex dormitories.
Because really, with all of the problems with our system of higher education, it’s whether or not boys and girls reside in the same physical building that’s the pressing issue worthy of supreme comment….

And now things get interesting. As we continue to run through the U.S. News 2012 law school rankings, we get to a crucial set of schools. The schools in this batch are certainly top tier, but they’re not “top 14″; for the most part, though, they charge like top 14 schools (especially the private ones).
So this is the batch of schools where we usually hear questions like: Should I go to this school at full price, or a much lower-ranked school for free? And our answer is usually, “How much lower-ranked are we talking about?”
The bottom line is that when people get into schools like Duke, or Penn, they are going to end up going to that school. But when people get into some of the schools on this list, they do seriously consider other options. Should I retake the LSAT, score better and apply again? How much financial aid am I getting? What’s the job market like in the [secondary market] this school is located in, just in case I get stuck there? Is it worth it to go into this much debt for a degree from that school?
These factors should come into play no matter which law school you get accepted to, but at this point on the U.S. News list, cost factors take on increased importance…
When Washington, D.C., was buried in snow last week, one suburban Maryland school alerted parents via robocall that they would be opening two hours late. The call, hypothetically letting parents know that they could sleep in that day, went out at 4:30 a.m.
That angered privacy lawyer Aaron Titus. His well-told tale of revenge reverberated around the media last week, thanks to a story in the Washington Post. Titus went Robocop on the school, using an online robocalling company to place a 4:30 a.m. call to the home phones of nine school board members, the school superintendent, and the school’s chief lawyer the next day, letting them know he hadn’t appreciated the early morning wake-up call. (The school said it made a mistake in setting the time for the calls and that it should have gone out at the immensely more reasonable hours of 5 or 6 a.m.)
Titus tweeted that he was following the Golden Rule. Meanwhile, other laws were possibly ignored…

Here’s some old bonus news (literally “last year’s” news). A few weeks ago, Shearman & Sterling announced its bonuses. They essentially matched the Cravath scale, but with the caveat (also issued last year) that they are at least partly “merit-based” — i.e., adjusted up or down based on performance. The S&S bonuses are being paid out on January 14.
Some Shearman associates might be upset by the lack of upward movement on bonuses. But at least one of them probably doesn’t care that much, since he enjoyed other income in 2010.

I have come to the conclusion that most Americans really enjoy three things:
Earning money, and
Buying food out of a truck.
Think about it. Remember as a kid when you would hear the music from your local ice cream truck making its way down your street? Remember running towards it as if your life hung in the balance, all the while thinking, MUST-GET-ICE CREAM-NOW!? And it didn’t matter whether you had 14 gallons of every conceivable flavor of ice cream at home; you just had to have your King Cone or Chocolate Chip Cookie Sandwich. Those were good times.
Well, roughly a year ago, George Washington University Law alum Sam Whitfield was reviewing documents for discovery as contract lawyer in Washington, DC, when he and his colleagues began craving cupcakes. The problem was no one wanted to venture across town to a local hot spot, Georgetown Cupcake,to pick them up. That’s when Sam had his first rendezvous with cupcake destiny.
“I thought, what if we could get cupcakes delivered to us?” he said. “I come up with three or four crazy ideas like this every day.”
Soon thereafter he found himself investing in a truck, a baker, and cake mix (lots of cake mix). In a very short time, Curbside Cupcakes was born, but would DC find his idea as delicious as he did?
Given the legal economy, prospective students should clearly be shooting for law schools in the top-15. But, not everybody can rock the all powerful LSAT. Going to a law school in this group can still result in Biglaw jobs for graduates who want them — especially if the school is located in the market where you ultimately want to practice.

Deal flow has clearly picked recently up for most US associates, counsels and partners in Hong Kong/China and Singapore. We are on the phone with a lot of these folks on a daily basis, many of whom we have known for years. Further, the head of our Asia team, Evan Jowers, and Kinney’s founder and president, Robert Kinney, frequently meet in person with leading US partners in Asia to assess their needs and keep on top of the inside scoop at as many firms as possible. The need for legal recruiting help in Asia from experienced recruiters appears to be live and well. In March, Evan and Robert were in Beijing at such meetings, in April, Evan was in Hong Kong, and for half of June Evan will be in Shanghai and Hong Kong. Thus its pretty easy for us to tell when there has been an across-the-market pick up in capital markets and corporate work.
On an average day in Asia when Evan and Robert visit firms, they typically have 5 to 9 meetings a day, mostly with US partners in the market. The reason they have these meetings is not simply because Kinney makes a lot of US attorney placements in Asia and that a particular firm may have openings; instead these are just visits with friends. After years of working together as business partners, the folks at Kinney are actually these peoples’ friends. The firms Kinney work closely with in Asia (which is just about every law firm – call us if you want to know the one firm in the world we will never place anyone with again, ever, and why) look forward to the visits, or at least act like they do. After seven years in the market, many of the client partners are former associate candidates. Also, these US partners see Kinney as a very good source of market information as well, because they know how deep their contacts are in the market and how frequently they are speaking to counterparts at peer firms.
In a land that is right here and in a time that is right now, a technology has arisen so powerful that it can replace basic human document review. Is it time to bow down before our new robot overlords?
First, here’s a little story about me: my life in the legal world began as a paralegal. My first case was a GIANT patent infringement case that was already six years old and had involved as many as five companies, multiple US courts, the ITC and an international standards committee. I knew nothing about any of this.
On my first day, my supervisor (a paralegal with at least eight other cases driving her crazy) sat me down in front of a Concordance database with a 100,000+ patents and patent file histories. “Code these,” she said. I learned that “coding”, for the purposes of this exercise, meant manually typing the inventor’s name, the title of the patent, the assignee, the file date, and other objective data for each document. I worked on that project – and only that project – for at least the first six months of my job. After a week or so, time began to blur.
What I know, in retrospect and with absolutely certainty, is that as time began to blur, so did my judgment. So did my attention to detail. If you could tell me that I did not make at least one mistake a day – one inconsistent spelling, one reversed day and month, one incorrectly spaced title – I frankly would need to see your evidence. I would not believe it. The human mind is trainable but it is not a machine.
