ATL International: 'We were just role-playing a German prison, not a Nazi German prison.'

Mosley_orgy.jpgBritish barrister Max Mosley is the president of the International Automobile Federation (F.I.A.). When he's not overseeing Formula One, he's into sadomasochistic sex play. Unfortunately for him, a $5,000 "party" that he arranged was caught on hidden cameras by News of the World, a British tabloid. The encounter, now on YouTube, involved German prison guards and lots of spanking.

Mosley is now seeking punitive damages from News of the World for invasion of privacy -- and for giving the story a Nazi spin. Such suits are almost never a good move from a PR-standpoint, since the trial brings even more attention to the source of embarrassment. Now every one from the New York Times to ESPN is reporting on it.

Taking the witness stand at the start of a two-week High Court hearing, Mosley said he had paid $5,000 for the "party," but insisted no Nazi fantasies were involved. The News of the World said participants wore German-style uniforms and spoke in German as they acted out scenes involving prisoners and guards.

Mosley said he and the women had acted out a German prison scenario, but without any military aspect.

Next time, Mosley should probably stick to British prison scenarios, to avoid the possible Nazi confusion.

The Nazi allegations are especially sensitive because Mosley is the son of the late Oswald Mosley, leader of Britain's fascist movement before World War II and a friend of Adolf Hitler.

"There was not even a hint of that," Mosley said of the Nazi claims. He said he could "think of few things more unerotic than Nazi role-play."

But, apparently, having a prison guard tell him to bend over a bench does the trick. More salacious details, after the jump.

Kids These Days: Or, Why You Should Always Sign Out of a Public Computer

Instead she went to the prestigious London School of Economics, from which she graduated with a master's degree in social psychology.

Interestingly enough, Lewinsky wrote a law-related thesis: "In Search of the Impartial Juror: An Exploration of the Third Person Effect and Pre-Trial Publicity." So maybe she's leaving the door open to law school at a later point in time.

If Lewinsky decides in favor of a legal education, she might want to consider Washington College of Law (WCL), at American University. Based on an amusing instant-messenger chat that has been making the rounds recently -- we received it from half a dozen different sources, so it's in wide circulation -- it seems she'd fit right in.

Lawyers of the Day: Drinkin' on Company Time vs DUI + Lovechild

Newsome.jpgWe couldn't choose between these two possible Lawyers of the Day, so we'll let them go head to head. You can decide who's the more deserving honoree.

In one corner, we have John Newsome, a district attorney in Colorado. Sources inside and outside the district attorney's office tipped off a local TV station to Newsome's carousing during office hours. From the Colorado Springs Gazette:

The television station aired its report Tuesday night after filming Newsome on a "recent afternoon" as he drank three 20-ounce beers and a 10-ounce beer during "work hours" over the course of less than two hours at Oscar's, a downtown Colorado Springs bar.

Newsome was then shown heading back to his office. An hour later, he drove his El Paso County-owned SUV to another bar, according to KOAA.

There, Newsome was reportedly seen drinking four more pints with Assistant District Attorney Amy Mullaney and then driving away. Mullaney was also drinking with Newsome earlier that day at Oscar's.

DA party-time! Woohoo. No criminal investigation, and he's running unopposed for reelection in November. Lucky guy.

Vito.jpgIn the other corner, we have Vito Fossella, who has a law degree from Fordham University. He's the U.S. congressman from New York who got busted for drunk driving in Virginia last week.

The DUI charge has led to the unraveling of his double life. Turns out the married father of three has a lady friend and lovechild in the D.C. region. From the New York Times:

Representative Vito J. Fossella, the Staten Island Republican who was arrested on drunken-driving charges in Virginia last week, acknowledged on Thursday that he had fathered a daughter, now 3, in an extramarital affair. But he declined to address questions about his political future.

Mr. Fossella, who has three children with his wife on Staten Island, issued a terse statement that said nothing about the events leading to his arrest, which occurred hours after he attended a White House reception celebrating the New York Giants’ victory in the Super Bowl.

At least he wasn't drinking during office hours.

McGreevey Divorce Trial Kicks Off

mcgreevey.jpgThe divorce trial of James and Dina Matos McGreevey gets under way today. Former New Jersey Governor James McGreevey resigned from the governorship in 2004, announcing that he was a "gay American," who had carried on an affair with a male advisor. The McGreeveys returned to the headlines earlier this year, when a different male aide claimed Mrs. McGreevey had gotten in on some three-way action with him and her husband.

From the New York Post, back in March:

"We called it the Friday Night Special," [former aide Teddy] Pedersen said. The "intense" escapades, he said, usually began with a "couple of drinks" at a local T.G.I. Friday's and culminated in "a hard-core consensual sex orgy" between the three of them at McGreevey's Woodbridge condo.

The three-way action, if true, complicates Dina Matos's claim that she was not aware of Jim McGreevey's homosexuality. From WCBS TV:

The first order of business are closed door proceedings concerning their six-year-old daughter. Jim McGreevey is seeking equal custody.

Dina Matos McGreevey wants $600,000 as compensation for time she would have spent in the governor's office had her husband not resigned in disgrace. She claims she was not aware of his homosexuality.

McGreevey is apparently studying to become an Episcopal priest right now, while his wife was recently called upon to offer analysis of the Eliot Spitzer scandal. So she didn't get to spend those years in the Jersey governor's office -- but now she's a scandal expert and talking head. Isn't that worth something?

Marc Dann.jpgMarc Dann is Ohio's attorney general... for now. But he won't be Case Western Reserve University's law school commencement speaker, per an e-mail from the dean this morning.

Dann was an ATL lawyer of the day honoree last month for running a dysfunctional office with staff accused of sexual harassment, DUIs, and ethics law violations. Oh, but there's more.

On Friday, Dann held a press conference where he revealed his affair with a staffer. Two of his staff were fired and two resigned last week, including the 28-year-old scheduler with whom Dann had the affair. If sleeping with the boss doesn't get you a raise and a promotion, what's the point? From the Cleveland Plain-Dealer:

Dann announced the affair at a news conference Friday morning, after investigators released a report on the sexual harassment investigation. The former state senator who once worked in a small Youngstown law firm blamed his inexperience and said he was not equipped to take over a state agency with more than 1,400 employees, including 400 lawyers.

"I don't know how many people here expected me to win the election, but I certainly was not among them. It was a surprise that I won," he said.

Saying that you didn't think you would actually win is the worst defense ever (and seems off-topic). Despite that, Dann says he plans to stay in office and clean up the mess. Good luck with that.

Dann had been slated to be Case Western Law School's commencement speaker on May 18, but the dean e-mailed the school this morning to announce Dann's withdrawal. Too bad. His speech could have been fun: "Hey kids, you too can use your Case Western degree to be a total f*#k-up, reward your friends with jobs, sleep with your scheduler, and tap state resources for personal use!"

Deborah Jeane Palfrey: 'Alleged' D.C. Madam No More

Madam," was suggested as a possible running mate for John McCain, the presumptive Republican presidential nominee. But thanks to a development from earlier this afternoon, that probably won't be happening. From the AP:

A federal jury has convicted a woman of running a high-end prostitution ring that catered to members of Washington's political elite.

The verdict against Deborah Jeane Palfrey was announced in a courtroom Tuesday afternoon.

Palfrey has repeatedly denied the escort service engaged in prostitution, and that any sex acts happened without her knowledge. Palfrey caused a sensation last year when she announced that she would sell her phone records to news outlets to pay for her defense.

But the trial didn't reveal many new details about the service or the identities of its clientele. Republican Sen. David Vitter of Louisiana was linked to the case but didn't testify.

Well, even if it wasn't as explosive as expected, the trial yielded up a few new juicy details. Like the fact that one of Palfrey's escorts was a former professor and university department chair. Or the fact that Palfrey's prostitution service was patronized by several well-pedigreed lawyers (including Yale law grad Christopher Sorrow, who is presumably pretty sorrowful about being involved in this mess). Or the fact that Palfrey employed "testers," like trial witness Paul Huang, to evaluate the suitability of aspiring escorts (think "Consume-Ho Reports").

And the show's not over just yet. Palfrey has made a spectacle of herself from the start of this case, and we still have a sentencing and possible appeal to look forward to. So stay tuned.

Update: Massachusetts Lawyers Getting Off

Carl McGee Carl Stanley McGee Governor Deval Patrick Above the Law blog.jpgFor the record, here's some follow-up on two Bay State lawyers previously discussed in these pages, who have been cleared of the charges against them. At least to some extent.

First, remember Carl Stanley McGee (right), who was arrested after being accused of going down on a 15-year-old boy? Earlier this week, Florida prosecutors decided to drop the case.

Apparently the teen had trouble identifying McGee. But maybe he also learned that it's bad form to complain about getting a BJ. Unless teeth are involved.

Second, remember the handsome Gary Zerola (below right), named a "Most Eligible Bachelor" by People magazine, and accused of rape and attempted rape by three different women? One of the cases against him went to trial, and he was acquitted (back in January; we missed the news when it came out).

The third incident, which is the one that we wrote about, has not yet gone to trial.

New York and New Jersey's rivalry has spilled over into sex scandals. New Jersey started the battle way back in 2004. Then-Governor James McGreevey resigned and announced he was a "gay American," who had carried on an affair with a male aide. This month, New York belatedly responded, when Eliot Spitzer resigned as governor amid a prostitution scandal.

New Jersey filed its reply brief. From the New York Post:

A former driver and aide to former New Jersey Gov. Jim McGreevey yesterday made the bombshell claim that Dina Matos McGreevey must have always known her husband was gay - because he was the other man in bed with them.

In an explosive interview with The Post, the McGreeveys' self-professed man in the middle, Teddy Pedersen, gave explicit details of three-way sex romps that he claimed to have had with the now-divorcing duo, starting during their courtship and continuing into the marriage.

Note: when conducting sex scandals, New Yorkers choose the Mayflower Hotel, while Jersey folks opt for drinks at T.G.I.F.'s:

So as far as nasty sex scandals, we declared a victory for New Jersey -- but then New York filed a petition for rehearing! The Daily News reports that new Governor David Paterson and his wife have both carried on extramarital affairs for years:

In a stunning revelation, both Paterson, 53, and his wife, Michelle, 46, acknowledged in a joint interview they each had intimate relationships with others during a rocky period in their marriage several years ago.

In the course of several interviews in the past few days, Paterson said he maintained a relationship for two or three years with "a woman other than my wife," beginning in 1999.

As part of that relationship, Paterson said, he and the other woman sometimes stayed at an upper West Side hotel — the Days Inn at Broadway and W. 94th St.

We are unable to name a "Dirtiest Governor Sex Scandal" victor just yet. We are mildly overwhelmed. We wish the McGreeveys, the Spitzers, the Patersons, and "Kristen" would just have one big orgy, to make our news coverage easier.

Liveblogging Eliot Spitzer's News Conference

It appears that the governor is running late. We're tuned in to CNN, and they just showed footage of the governor's motorcade leaving from his Upper East Side apartment -- previously profiled here (Fifth Avenue, 3BR/3BA, Central Park views) -- to his offices downtown.

11:35 AM: The CNN commentators are saying that Governor Spitzer is planning to announce his resignation, but it apparently won't take effect until Monday, March 17. This would give the governor a week to "take care of business."

11:42: Governor Spitzer is in the building. It seems we're about to get underway.

11:43: Governor Spitzer takes the podium and unfolds a small piece of paper; it looks like he'll be speaking from notes. He's wearing a dark suit and white shirt -- the uniform of the upstanding prosecutor. But should he still be allowed to wear a white shirt? It's like a super-slutty bride wearing white on her wedding day. Who are you fooling?

Governor Spitzer's wife, Silda Wall Spitzer, is once again standing by her man -- literally, and as she did on Monday. She's wearing a dark suit and a fabulous scarf (red, blue, cream, and gold). But she looks a bit haggard, and her face bears a dead expression. She's not a happy camper.

11:44: Governor Spitzer speaks. Expressions of remorse for what he did, and gratitude for his family's love and support. Emphasis on "private" failings. Apologies to the people of New York for not living up to their public trust. No specific description of his indiscretions.

11:45: "I cannot allow my private failings to disturb the people's work... For this reason, I am resigning from the Office of Governor." At Lieutenant Governor David Paterson's request, it will take effect on Monday, March 17.

11:46: Concludes by expressing thanks for "the privilege of service." He borrowed that line from "Kristen."

No questions. Governor Spitzer has left the podium and the room.

Update (2:30 PM): Press conference scheduled for 2:15 p.m., but Governor Spitzer is running 15 minutes late. "I don't blame him," said Ben Smith of the Politico, interviewed just now on CNN.

Update (2:35 PM): Jeffrey Toobin, who was an HLS classmate of Eliot Spitzer, described the news as "a total shock." He said Spitzer has been "nothing but a straight arrow" for many years.

Update (2:50 PM): Still no press conference. Brooke Masters, author of Spoiling for a Fight: The Rise of Eliot Spitzer, was just interviewed on CNN. She noted that this scandal comes at a bad time for Spitzer politically, in the wake of last year's scandal involving his misuse of the State Police for political purposes.

Carl McGee Carl Stanley McGee Governor Deval Patrick Above the Law blog.jpgThe day is still young, but we already have our Lawyer of the Day -- and we doubt that anyone we hear about later today can steal this honor away from him. Via the Boston Globe:

A top official in the [Gov. Deval] Patrick administration has been placed on unpaid leave because he was arrested in Florida and charged with sexually assaulting a 15-year-old male in a steam room at a $500-a-night Gulf Coast resort.

Carl Stanley McGee, 38, assistant secretary for policy and planning, is scheduled to be arraigned next week for sexual battery in Lee County, Fla.... According to police reports, McGee was arrested Dec. 28 and accused of performing oral sex on the 15-year-old, who was a guest at The Gasparilla Inn & Club, a 95-year-old hotel and championship golf course in Boca Grande.

As they like to say up in Massachusetts, "Thar he blows."

McGee, a former Rhodes scholar and Harvard Law School graduate, was previously a corporate lawyer at the law firm WilmerHale. He was instrumental in the movement seeking to defeat efforts to overturn legalization of same-sex marriage, serving as director of the civic and business outreach efforts of the advocacy group MassEquality.

A year after same-sex marriage became legal in Massachusetts in May 2004, McGee's wedding to John Finley IV was highlighted in the "Vows" section of The New York Times....

Known for his shock of platinum hair, McGee was named one of The Boston Globe's 25 most stylish Bostonians in November. In the article, he described his style as "traditional, but it's also subversive and ironic."

"Traditional," but "subversive." Sort of like married men engaging in steam-room hook-ups?

Good thing Carl McGee isn't running for office. We're reminded of the famous quotation by former Louisiana governor Edwin Edwards, who once boasted that he couldn't lose an upcoming election unless he was "caught in bed with a dead girl or a live boy."

Update: Just a reminder that these are obviously mere allegations. Sources mentioned in the Globe article said they "were stunned by the news of McGee's arrest and said they do not believe the charges." One colleague of McGee told the paper, "I know it didn't happen."

Further Update: Best comment thus far, from an observant, Spanish-speaking reader: "He was arrested for blowing a 15 year old in... huhuhuh... Boca Grande..."

Lawyer of the Day, People's Choice: Beth Modica

So we nominated a quintet of contenders: a North Carolina lawyer caught reading Maxim in court, a former prosecutor who allegedly had sex with two teenage boys, an AUSA arrested on DUI charges, a Canadian lawyer/politician who allegedly overbilled an order of nuns, and a Chicago lawyer who keyed a Marine's car. Then we had you vote on who should take the honors.

Participation was enthusiastic, with almost 1,300 votes cast. Two contenders emerged early in the voting: Beth Modica, the allegedly predatory prosecutrix, and Jay Grodner, who pleaded guilty to keying the Marine's vehicle. Competition was fierce. But in the end, Mrs. Modica came out on top.

So congratulations, Beth Modica. You take the prize as Monday's Lawyer of the Day!

Lawyer of the Day: People's Choice

vote ballot Above the Law blog.jpgLast week was a busy one in terms of bonus news. In addition, we were prevented from publishing as much as we wanted by technical difficulties (which lie outside the jurisdiction of your undersigned blogger, a mere writer and not a tech person).

Our recent neglect of the "misbehaving lawyers" beat has given rise to a backlog of possible Lawyers of the Day. We've decided to clear the backlog by tossing out five nominees and having you vote on who should get the honor.

Click on each lawyer's name to read more about their alleged misadventures. Then vote on who should be our Lawyer of the Day.

1. Todd Paris: This North Carolina lawyer was held in contempt after a judge caught him reading Maxim [quasi-NSFW] in court. "When [Judge Kevin] Eddinger gave Paris a chance to respond he apologized and 'stated in his view the magazine was not pornography, was available at local stores and that he did not intend contempt,' the [contempt] order said."

2. Beth Modica: "A former suburban prosecutor and PTA president had sex with two underage boys, joined many other teens in booze and pot parties and kept it all a secret from her police chief husband, officials said Tuesday. Beth Modica, 44, was indicted on 35 counts alleging statutory rape, criminal sex acts, sex abuse and endangering children. Wearing an olive-gray suit and handcuffs, she pleaded not guilty at her arraignment in Rockland County Court and was ordered held on $75,000 bail."

3. Mikal Hanson: "Pierre police early Thursday morning arrested an assistant U.S. attorney, who is accused of drunken driving and speeding. Mikal Hanson, 52, an assistant U.S. attorney in Sioux Falls, was stopped by police shortly before 1 a.m. for speeding, said Pierre Police Chief Elton Blemaster. The arresting officer could smell alcohol on Hanson and asked him to perform field sobriety tests, Blemaster said. 'Mr. Hanson didn't complete them as instructed,' he said."

4. Canadian Senator Mobina Jaffer: "Liberal Senator Mobina Jaffer is under investigation by the Law Society of British Columbia for allegedly overbilling one of her legal clients, including charging for 30 hours of work in a single day.... Jaffer has been called before the law society to account for more than $6 million in legal bills charged to her former client, a Catholic missionary order known as the Oblates of Mary Immaculate."

5. Jay Grodner: From the Chicago Tribune (via Blackfive.net):

Jay Grodner, the Chicago lawyer who keyed a Marine's car in anger because the car had military plates and a Marine insignia, finally got his day in court last week. Grodner pleaded guilty in a Chicago courtroom packed with former Marines. They came to support Marine Sgt. Michael McNulty, whose car Grodner defaced in December, but who couldn't attend because he's preparing for his second tour in Iraq....

"You caused damage to this young Marine sergeant's car because you were offended by his Marine Corps license plates," said Judge [William] O'Malley....

"That's because there is a little principle that the Marine Corps has had since 1775," the judge continued. "When they fought and lost their lives so that people like you could enjoy the freedom of this country. It is a little proverb that we follow: "No Marine is left behind.

"So Sgt. McNulty couldn't be here. But other Marines showed up in his stead. Take him away," said the judge and former Marine.

The mayor of Detroit was sexing up his chief of staff, who just happened to be a Wayne State Law Student. The mayor happens to be married with three kids. They may have perjured themselves.

No, not the kids -- Mayor Kwame Kilpatrick and his lover. From the Detroit Free Press:

Detroit Mayor Kwame Kilpatrick and his chief of staff lied about their relationship last summer at a police whistle-blower trial that has cost the cash-strapped city more than $9 million, according to records obtained by the Free Press.

The false testimony potentially exposes them to felony perjury charges, legal experts say.

Kilpatrick and chief of staff Christine Beatty denied during testimony in August that they had a sexual relationship. But the records, a series of text messages, show them engaged in romantic banter as well as planning and recounting sexual liaisons.

Judge of the Day: Colleen Hartl

Colleen Hartl Judge Colleen Hartl Above the Law blog.jpgMunicipal court is not exactly the pinnacle of judicial office. But we think that Colleen Hartl, until recently a (rather attractive) municipal court judge in Washington state, is still a worthy Judge of the Day. From the AP:

A Federal Way [that's a WA city name] Municipal Court judge has resigned after hosting a holiday party at which she claimed to be having an affair with a public defender who routinely appeared in her court.

Judge Colleen Hartl quit Dec. 19, less than a week after telling her guests -- including five court employees -- that she had sex with public defender Sean Cecil and displaying a text message in which he complimented how she looked in "tight jeans," Michael Morgan, the court's presiding judge, said Wednesday.

So she's proud about how good her butt looks in tight jeans. What's so wrong with that?

Even after admitting the affair at the Friday night party, Hartl showed up for work the next Monday morning and presided over several cases handled by Cecil, Morgan said. At lunchtime that day, Morgan -- who attended the party but left before Hartl's admission -- was advised of the relationship by a court staff member who witnessed the statement. Morgan suggested that Hartl not sit on any cases that afternoon, and she resigned two days later.

Judge Hartl, we like your style.

Lawsuit of the Day Last Month: Talk About a 'Special' Bonus

We described Schoenfeld v. Allen & Overy, a lawsuit by a Jewish associate against his former law firm, as "the Jewish version of Aaron Charney v. Sullivan & Cromwell." Now we're looking at "the pervert-who-has-sex-with-13-and-15-year-old-sisters version of Charney v. S&C."

From the New York Daily News:

A disgraced lawyer who paid a mother to allow him to have sex with her underage daughters is looking for a payday of his own - from the elite law firm where he once worked.

James Colliton is suing Cravath, Swaine & Moore for $1.45 million, accusing the white-shoe firm of stiffing him on an annual bonus, salary and vacation pay.

Reached by phone at his home in Poughkeepsie, the convicted sex offender refused to talk about his suit, which was handwritten on notebook paper.

"It's all in there," Colliton said.

That's what he told her. Also, we'd expect better than a complaint "handwritten on notebook paper" from James Colliton. If Aaron Charney can type up his pro se complaint against his former firm, surely an ex-Cravath lawyer can do the same.

Lawsuit of the Day: Model Files Suit Over Super-Sexy Spot

A model who says she has worked hard to maintain a wholesome image has filed a $5 million lawsuit complaining that a jewelry company's video advertisement in which she writhes and moans looks pornographic.

The commercial, seen on the Internet in a clip entitled "Rock Her World," shows a woman wearing blue lacy lingerie and a diamond necklace while moaning and stroking her face and neck. It ends with the Web address for the jewelry company, Szul.com.

The 37-year-old woman claims in her lawsuit that she did not "consent to or authorize the use of her likeness, picture, image or name to simulate a female having an orgasm or otherwise experiencing sexual pleasure."

Actually, we prefer the description of the New York Daily News:

The 35-second "Rock Her World" spot features the model rubbing her teal teddy and purring with pleasure to the hard-grinding sounds of a guitar as the slogan, "Jewelry works every time" pops up onscreen.

But look, no need to rely on print descriptions of the ad. One of the beauties of the internet as a medium is that, when it comes to audio or video, you can judge for yourself. So check out the clip -- which, we warn you, is quasi-NSFW (at least with the sound turned on) -- over at Blogonaut.

Done watching? Okay. We concur with our fellow blogger:

[W]e find it hard to believe that Jane Doe’s behavior on the ad could be taken for anything resembling the “wholesome” persona she claims was maligned. What could she have been thinking when she made the ad?

Indeed. What exactly did she think she was advertising when she consented to be filmed, clad in pastel lingerie, writhing on a bed? Anti-epilepsy drugs?

Anyway, casting directors, consider yourselves warned. If the woman from the Szul Jewelry ad shows up for your casting call, don't even think of using her in that Herbal Essences ad.

Oh, and the "I'll have what she's having" scene from When Harry Met Sally? NOT FUNNY.

Update: Ted Frank has written about the case at Overlawyered. We like the title of his post, as well as this quip: "And, of course, she didn't have to roll around on the bed in the first place."

But he notes, in fairness, that the model-plaintiff is claiming no release (hehe). That might be a legitimate basis for a lawsuit.

Judge of the Day: John Hagler

John Hagler Judge John B Hagler Above the Law blog.jpgLast month, Judge John B. Hagler, a state court judge in Tennessee, stepped down from the bench. Here's why, from the AP:

A Tennessee judge resigned last month after making a recording of fantasies so lurid that when the tape fell into the hands of the police and FBI, they thought they were listening to a torture session and believed it might be linked to a murder case.

Police have cleared the judge in the murder case. But a hearing started yesterday over whether they must release the tape.

So, pray tell, what exactly is this tape about?

"It sounded like someone being tortured," Chattanooga police Sgt. Alan Franks testified Wednesday, offering the first details of what is on the tape.

Franks said the recording was investigated in relation to a still-unsolved 1997 murder. He gave no other details on the murder case.

"The content was so shocking. I have been a police officer for 24 years," Franks said before his testimony was cut off by an objection.

Well! What does Judge Hagler have to say for himself?

Hagler said that he had done nothing wrong but that the recording had caused great embarrassment to friends, family and the courts. Hagler, who is 65 and married, has been a circuit judge in Cleveland, Tenn., since 1990 and served three terms as president of the Tennessee Trial Judges Association.

"The description of it as containing 'graphic fantasies' ... is an accurate and sufficient description and all any decent person would want to hear of it," the judge said in a statement.

Should we be troubled by the trend of excessively scrutinizing the unorthodox sexual practices of judges? See also Judge Herman Thomas, aka the Spanking Judge, who resigned a few months ago.

Aren't judges entitled to be a little kinky too? If judges have to worry about their personal lives being placed under the microscope, will the state and federal benches lose out on potentially talented jurists, who just happen to have a little sumthin sumthin going on under those robes?
