When it comes to the madness that ensues during the deposition process, we really thought that we had seen it all. We’ve seen witnesses curse at the questioners. We’ve seen a deponent tell an attorney to “suck [his] dick.” We’ve even seen a former Biglaw partner call his opposing counsel an “ignorant slut.” But we’ve never seen something like this.
Apparently when attorneys in Florida get bored during depositions, they turn to their artistic side to get their creative juices flowing. Because there’s nothing like a great dick pic to bring your attention back to the case at hand….
Thoreau admonished us that we cannot “kill time without injuring eternity.” But what did he know? That proto-hippie pond-fetishist could not have imagined today’s world, where our collective attention spans have shriveled to goldfish levels and so much actual productive white-collar labor can be, to an observer, indistinguishable from simply loitering in front of a computer screen. Unless someone is looking over your shoulder, nobody knows whether you’re on PACER or playing Angry Birds.

On Thanksgiving Day, while you were enjoying your turkey (or tofurkey), we wrote about a different bird: namely, the ostrich. In a somewhat snarky opinion, Judge Richard Posner of the Seventh Circuit compared a lawyer appearing before him to an ostrich: “The ostrich is a noble animal, but not a proper model for an appellate advocate. The ‘ostrich-like tactic of pretending that potentially dispositive authority against a litigant’s contention does not exist is as unprofessional as it is pointless.’”
Ouch. Judge Posner even included a photo (above right) of a man in a suit burying his head in the sand.
What did the lawyer in question, David “Mac” McKeand of Houston, have to say for himself? And what did McKeand have to say about Judge Posner?
I was a late adopter of the iPhone, but now iLove it. And I am constantly on the lookout for the newest app. Earlier this week, I was mesmerized by SceneTap. This app allows lonely singles to maximize their efforts to get laid. Through facial recognition software, SceneTap enables users to hone in on the bar with the best scene (i.e., more women than men, more men than women, percentage of pretty young things, etc.).
With apps changing the way we date, diet, read, and generally function, I wondered how apps were affecting the way in which small-firm attorneys practice. Thanks to a tweet from @LarryBodine, I found my answer. Well, at least I found the answer for one small-firm lawyer….

The legal industry is being disrupted at every level by technological advances. While legal tech entrepreneurs and innovators are racing to create a more efficient and productive future, there is widespread indifference on the part of attorneys toward these emerging technologies.
When the LexisNexis Cloud Technology Survey results were reported earlier this year, it showed that attorneys were starting to peer less skeptically into the future, and slowly but surely leaning more toward all the benefits the law cloud has to offer.
Because let’s face it, plenty of attorneys are perhaps a bit too comfortable with their “system” of practice management, which may or may not include neon highlighters, sticky notes, dog-eared file folders, and a word processing program that was last updated when the term “raise the roof” was still de rigueur.
