* Obamacare’s individual mandate may be in jeopardy, and it’s all because of that stupid broccoli debate. No, Scalia, as delicious as it is, not everyone would have to buy broccoli. [New York Times]
* Biglaw firms aren’t going away, but thanks to the recent onslaught of partner defections to small law firms, their high hourly rates might soon be going the way of the dodo. [Corporate Counsel]
* The “good” news: Northwestern Law will be limiting its tuition hike to the rate of inflation. The bad news: next year, it will cost $53,168 to attend. I officially don’t want to live on this planet anymore. [National Law Journal]
* A Littler Mendelson partner is recovering from a stabbing that occurred during a home invasion. On the bright side, at least he’s not a partner at Dewey — that’s a fate worse than being stabbed these days. [Am Law Daily]
* Law school applicants are dropping like flies, but some law schools were able to attract record numbers of students. UVA Law must have some real expertise in recruiting collar poppers. [The Short List / U.S. News]
* “I have a suggestion for you; next time, keep your [expletive] legs closed.” O Canada, that’s the basis of one crazy class action suit, eh? Dudley Do-Right would never treat a female Mountie like that. [Globe and Mail]

Justice Scalia's Advice: Don't Work Too Hard, Move to Cleveland
On Monday, as the world was learning about Justice Stephen Breyer getting robbed at machete-point, fellow Justice Antonin Scalia was getting cozy in the hallowed halls of the University of Chicago Law School. A few years ago, Scalia criticized the law school's political drift to the left. But just before Valentine's Day, they kissed and made up. On Monday, Scalia gave a speech at U. Chicago, where he used to teach (and served as faculty advisor to the Federalist Society). He also offered some, how shall we say, unexpected career advice for attorneys who are just starting out.... - Sponsored

Breaking: SCOTUS Rules in Highly Anticipated GPS Tracking Case
Yesterday, the Supreme Court just handed down a unanimous ruling in one of the most closely watched cases of the year. All the justices agreed on the result, but diverged significantly in reasoning. The central issue in US v. Jones was whether attaching a GPS device to a car (i.e., allowing law enforcement 24/7 access to a person's movements), without obtaining a warrant first, violated the Fourth Amendment. What did the justices say? The ruling might surprise you.... -

Supreme Court Rules on Sullivan & Cromwell's Mailroom of Death
We've previously written about the mailroom of death at Sullivan & Cromwell. To make a long story short (read our prior posts for the full background), a mailroom mix-up at 125 Broad Street caused an Alabama death-row inmate to miss a deadline for filing an appeal. The Eleventh Circuit rejected the condemned man's attempt to reopen his case. Presumably feeling bad for what had happened, S&C appealed to the Supreme Court. Yesterday, the Supreme Court handed down its ruling in Maples v. Thomas. What did the high court have to say? -

A Portrait of Elena Kagan as a Young Justice
The latest issue of New York magazine contains a very interesting profile of the U.S. Supreme Court’s newest member, Justice Elena Kagan, penned by Dahlia Lithwick. Here’s the bottom-line summary of the piece (via Ezra Klein): “While Kagan is assuredly a liberal, and likely also a fan of the health-reform law, a close read of […]

Some lawyers can be so circumspect in speech and so careful in action that they’re just plain boring. Quote of the Day: And What About Citizens United?
My court has, by my lights, made many mistakes of law during its distinguished two centuries of existence. Dred Scott was one mistake of […] -

Same-Sex Dorms: The Cure For Pre-Marital Sex OR The Dumbest Controversy This Month?
Speaking at Duquesne University School of Law, the Pittsburgh Tribune-Review reports that Antonin Scalia said: "I hope this place will not yield -- as some Catholic institutions have -- to this politically correct insistence upon suppression of moral judgment, to this distorted view of what diversity in America means." Apparently, this was Scalia's way of supporting Catholic University's same-sex dormitories. Because really, with all of the problems with our system of higher education, it's whether or not boys and girls reside in the same physical building that's the pressing issue worthy of supreme comment.... -
