Should the parties choose to string this case out to trial on the merits, the Court encourages reasonable discovery intercourse as they navigate the peaks and valleys of litigation, perhaps to reach a happy ending.
– Chief Judge Fred Biery of the Western District of Texas, denying a preliminary injunction sought by strip club owners in San Antonio who are challenging city regulations that would require bikini tops instead of pasties to avoid stringent licensing requirements.
(The Chief Judge produced over seven pages of genius double entendre. Check out the full opinion, which he entitled “THE CASE OF THE ITSY BITSY TEENY WEENY BIKINI TOP V. THE (MORE) ITSY BITSY TEENY WEENY PASTIE,” after the jump….)
The court does not expect the parties to hold hands and sing ‘Kumbaya’ around a campfire beside the Medina River. Nor does the court expect the respondents to engage in a public spectacle of self-flaggellation for communicating words better left unsaid. Moreover, the court does not expect plaintiffs to become Traditional Christians, though the court suggests plaintiffs might follow the moral and civility lessons of Matthew 5:39 (‘if someone strikes you on the right cheek, turn to him the other also’)[.]
– Chief U.S. District Judge Fred Biery’s “non-Kumbaya” order in a contentious San Antonio-area school prayer case.
Three years ago, we bestowed Judge of the Day honors upon the Honorable Fred Biery, a federal judge in the Western District of Texas. Back in 2008, Judge Biery rejected a religious school’s attempt to join an influential statewide extracurricular organization. In the process of ruling against Cornerstone Christian Schools, Judge Biery took the Bible and turned it around on them, in a snarky opinion quoting religious texts to refute a religious school.
(His Honor apparently enjoys colorful writing. See also this amusing ruling, with shout-outs in the footnotes to such fabulous creatures as Barbra Streisand and Stephen Sondheim.)
Well, it seems that Judge Biery — make that Chief Judge Biery, as of last June — continues to antagonize organized religion. Let’s read about the latest controversy he’s incited, this time involving an imminent high school graduation ceremony….
UPDATE: Judge Biery’s ruling in the case discussed below was overturned on Friday afternoon by the Fifth Circuit. Details and links appear in the update at the end of this post.
Those Texans love the word of God. In 2005, they went to SCOTUS to defend a monument to the 10 Commandments that stands on the grounds of the Texas State Capitol. Hailing from San Antonio, U.S. District Judge Fred Biery is invoking the higher power in his judgment against a religious school’s right to join a Texan school membership league.
In a ruling Tuesday denying Cornerstone Christian Schools’ attempt to join the state’s premier extracurricular organization, a federal judge chided the school’s founder and famed preacher John Hagee for contradicting at times his own Christian tenets, using numerous references to the Bible, Koran and even a famous fairy tale.
Who needs precedent and constitutional law when there’s so much wisdom to be found in Grimm tales and Disney movies? Let’s look at the opinion….

When Chintan Panchal decided to leave a global BigLaw partnership to start his own firm, he could only hope that he would face the high-quality problem of firm building that many had cautioned him about. Focused on the uncertainty surrounding of a new firm launch, he decided to tackle staffing needs, IT challenges, and financial planning requirements after he had built up his legal practice.
Panchal Associates LLP–a corporate/finance and outside general counsel boutique–was quickly off to a great start. Clients and matters were flying in the door, and Chintan soon had a team of lawyers and staff with a variety of operational needs. To continue building an excellent team and provide them with a competitive benefits package, to expand his physical presence to include a European practice and additional partners, and to scale his operations and IT capabilities to support this growing enterprise brought with it demands of time, money, and expertise. Chintan knew he needed help.
“With the assistance of NexFirm, we have upgraded the capabilities of our firm to meet, and in some cases exceed, the standards we were used to at our former BigLaw firms. Operationally, we can now attract and service clients we didn’t have the bandwidth to support in the past, and continue to build our team with the best and brightest legal talent in the industry,” said Chintan Panchal, adding “It has worked out quite well in our case; NexFirm is an essential partner for us.”
