For the record, that was not the “royal ‘we’” in the title — here at Above the Law, we pay our interns. But a whole lot of folks don’t, because when no one else is hiring, companies can get away with offering to hire folks for the promise of experience and a cup of coffee (disclaimer: “Cup of Coffee” not provided).
Mercifully, law firms haven’t succumbed to the impulse to bring on interns for free. Oops, spoke too soon (fourth item).
But Judge William Pauley of the Southern District of New York delivered some big wins for unpaid interns yesterday…
* Texas law student/international small-arms dealer Cody Wilson got shot down (pun!) days after revealing a fully security-proof 3D printable gun. The State Department pointed out that Wilson seems to be violating all manner of international arms agreements, which was pretty obvious when he went on video boasting about how his weapons were being used in hotbeds of civil strife. At the end of January, we brought you a detailed report on a lawsuit filed by former prosecutor and Court TV analyst Matthew Couloute Jr., who alleged that his ex-girlfriends had taken to the internet to let loose about his alleged infidelities. His exes’ scathing words were found on LiarsCheatersRUs, a website created to “save others from the heartache” associated with a cheating significant other.
In his suit, Couloute alleged that his former girlfriends, Amanda Ryncarz and Stacey Blitsch, had caused “tortious interference with [his] prospective business relations” by virtue of their online diatribes. After all, if you Google any derivative of the man’s name, one of the first few hits that appears is his profile on the scandalous cheaters website.
All the man wanted was a clean Google search, but it looks like he’s never heard of the Streisand effect. Now, just about every piece of information about Couloute that can be found on the web relates to his lawsuit, including the latest ruling made by Judge Harold Baer….
We’ve come a long way from the days when federal courts issued orders banning racial discrimination. Now federal judges hand down orders mandating, or at least encouraging, race-based discrimination.
As reported in the American Lawyer, earlier this week Judge Harold Baer (S.D.N.Y.) issued an unusual order. On Monday, Judge Baer directed two firms serving as lead counsel in a securities class action to “make every effort” to staff the case with at least one minority and one woman:
ORDERED that Co-Lead Counsel, Robbins Geller Rudman & Dowd LLP and Labaton Sucharow LLP, shall make every effort to assign to this matter at least one minority lawyer and one woman lawyer with requisite experience….
If federal judges can run school districts and prison systems, law firms should be a piece of cake, right?
The legal industry is being disrupted at every level by technological advances. While legal tech entrepreneurs and innovators are racing to create a more efficient and productive future, there is widespread indifference on the part of attorneys toward these emerging technologies.

We at Kinney Asia have made a number of FCPA / White Collar US associate placements in Hong Kong / China thus far in 2014. Most of such placements have been commercial litigation associates from major US markets, fluent in Mandarin, switching to FCPA / White Collar litigation. Some have already had FCPA experience, but those are difficult candidates for firms to find (this will change in coming years as US firms are now promoting FCPA / White Collar to their 2L summers who are fluent in Mandarin and have an interest in transferring to China at some point).

There is a new trend in the market, though, where mid-level transactional US associates, fluent in spoken Mandarin and written Chinese, are interviewing for and in some cases landing junior FCPA / White Collar spots in Hong Kong / China at very top tier US firms.
When the LexisNexis Cloud Technology Survey results were reported earlier this year, it showed that attorneys were starting to peer less skeptically into the future, and slowly but surely leaning more toward all the benefits the law cloud has to offer.
Because let’s face it, plenty of attorneys are perhaps a bit too comfortable with their “system” of practice management, which may or may not include neon highlighters, sticky notes, dog-eared file folders, and a word processing program that was last updated when the term “raise the roof” was still de rigueur.
