Litigators get away with a lot of obnoxious stuff during discovery. For better or worse, the pre-trial discovery phase of civil litigation is every lawyer’s opportunity to relive those times when parents leave kids alone for the first time: every slight, disagreement, and jealousy on a slow boil explodes into anarchic back-biting once there’s no authority figure around to enforce civility. Bring on the mean-spirited letters and smack-talking RFAs.
When it comes to depositions, it doesn’t always reach “fatboy” levels, but a federal deposition isn’t a deposition until someone threatens to call the magistrate — though never does.
Which is why this benchslap, where a federal judge levies a sanction straight out of elementary school, is so appropriate….
As I’ve mentioned previously in this column, it’s tough starting out as a new lawyer – particularly in today’s economic climate. Many lawyers have been forced into small firms or into hanging their own shingle. While many people seek out these avenues of practice, many are forced into them. Either way, it’s difficult to do so straight out of law school. On top of that, most new lawyers have mounds of non-dischargable student loan debt, are unprepared for actual practice (thanks law school!), and are potentially going up against lawyers with much more experience.
Most new lawyers who want to find success in these times devote themselves to working hard, building relationships, and developing a reputation for honesty and integrity. But if you’re determined to shoot yourself in the foot, repeatedly, then I offer The 12 Steps To Ruining Your Reputation….

* A lawsuit against Curt Schilling, based on allegations that he deceived the state into giving his company $75 million, will go forward. Like most conservative Republicans, Schilling saw no problem with taking millions in handouts from the government so long as poor people don’t get $4.50 a day for food. [Comcast SportsNet]
* Judge Mark Bennett (N.D. Iowa) ripped the Department of Justice for creating massive drug sentencing disparities because the DOJ went years without a policy for when prosecutors should double the prison time for repeat offenders. In Northern Iowa, that’s a LOT of meth heads in prison. [Des Moines Register]
* Attorneys for the Governor of Pennsylvania equate gay marriage to letting 12-year-olds marry. Just because a demographic calls everything “gay” doesn’t make them gay. [ABA Journal]
* Study shows academics use lots of adjectives and adverbs. This is really a very terrific and awesome study. [TaxProf Blog]

Not United States District Court Judge Mark Bennett. No sir.
We’ve written about Judge Bennett before. He’s a funny guy. The last time we saw him, he was expressing his personal bias against “East Coast law firms,” in part because he think big city lawyers possess “unsurpassed arrogance.”
But Judge Bennett might be selling himself short. I don’t think the average East Coast lawyer’s arrogance even approaches what His Honor rolls with…
But Judge Bennett is making waves of his own in his Iowa courtroom. He’s decided that he wants lawyers to participate in an auction to determine who will get to serve as lead counsel in some consolidated antitrust cases.
And he informed lawyers of this with a curious email. The subject line alone is not something one expects from a federal judge:
Waterman v. VS Holding Co. et al (10cv4038) – consolidated antitrust actions – “going once, twice, sold to the lowest bidder” – ready to rumble?
Not only is this judge “ready to rumble,” he’s also ready to insult lawyers from East Coast law firms…
