I’ll have been here for six years this summer, and I still read most of the comments to most of my posts. I rarely respond, unless I’ve been drinking, which I do almost constantly, so you do the math. But it’s been years since I’ve directly addressed commenter concerns in an actual post.
In my post about the Ivy League law grad who is struggling to pass the bar and build a career, I expressed sympathy for the graduate’s plight. It was a sad story that was powerfully expressed and tugged at my nearly blocked heart.
But commenters claimed that my sympathetic response to the Ivy League grad was because the person went to top law schools. They argued that I would not be nearly as nice to a person who struggled in the same way after going to a non-elite school.

We’ve received many emails here from struggling law students or recent law grads who have high debt and no job. Some of them deserve mockery. Some of them are good jumping off points for a discussion on the failures of legal education.
But this one is just sad. I feel bad for this person. The kid went to Columbia, got an LL.M from Cornell, but has now failed the bar four times.
I don’t have any flip or snarky internet advice. I just honestly hope that somehow things get better for this person. I think I’m feeling what you humans call “sympathy”…
You’ve graduated from law school. Congratulations! There’s just one small problem: you’ve now got six figures of debt attached to your name, and you have absolutely no idea how to pay it all off. You’re determined to do it, though, come hell or high water.
Having a modest income, you signed yourself up for income-based repayment. You thought (perhaps mistakenly) that it would be the best option for you. You want to get all of your financial ducks in a row so that you’ll be able to make the most of your future.
Alas, your Mint account just told you that you’re doomed…
If you think you can buy this at Costco, your brain probably fits in this box.
If you walk into a Costco, buy a diamond ring, and think you are getting a “Tiffany” ring, you are an idiot and I have no sympathy for you. You deserve what you get and should probably practice breathing through your nose before going out in polite company.
But, luckily, Tiffany wants to stop you from being so easily fooled. Not because they care about you, per se. But because the thought that even one person thinks that Tiffany is selling rings through Costco is horrifying to them. It’s like asking a Penn student if they make it to football games in Happy Valley.
As we mentioned in Morning Docket, Tiffany filed a lawsuit against Costco to protect their brand….
To date, we’ve received nearly 8,000 responses to our ATL Insider Survey. Among other things, our survey poses this question to law firm lawyers: “If you had the chance to do it all over again, would choose to work for your firm?”
Unsurprisingly, those who answer “yes” tend to highly rate their firms in such areas as compensation, culture, and training. For those that wish they could take a Mulligan when it comes to their choice of employer, the inverse is true. Here is a comparison of ratings scores (on a scale of 1-10) for the various aspects of law firm life, broken out by responses to the “Mulligan” question:

Hardly counterintuitive stuff, we know, but it allows us to use the “Mulligan” response as a proxy for overall happiness/satisfaction, as it’s so broadly predictive of the nature of the individual’s assessment of his firm.
Back in April, we shared our survey findings showing that Davis Polk was the top firm when it came to morale (to date, this holds true.) Today, we look at whether there are notable differences regarding satisfaction based on practice area. If we slice our survey data by practice, we find that there certainly are. So after the jump, let’s look at how practice groups stack up against one another in terms of the happiness of its practitioners….

The legal industry is being disrupted at every level by technological advances. While legal tech entrepreneurs and innovators are racing to create a more efficient and productive future, there is widespread indifference on the part of attorneys toward these emerging technologies.
When the LexisNexis Cloud Technology Survey results were reported earlier this year, it showed that attorneys were starting to peer less skeptically into the future, and slowly but surely leaning more toward all the benefits the law cloud has to offer.
Because let’s face it, plenty of attorneys are perhaps a bit too comfortable with their “system” of practice management, which may or may not include neon highlighters, sticky notes, dog-eared file folders, and a word processing program that was last updated when the term “raise the roof” was still de rigueur.
