* Two female students at the University of Oregon School of Law accused a male student of drugging and raping them. How did the student body respond? A listserv flame war, of course. [Portland Oregonian]
* Attorneys representing survivors in the Costa Concordia crash claim that traces of cocaine were found in the hair of the ship’s captain. I’m not sure how, but this needs to be the basis for a Head and Shoulders commercial. [Philadelphia Inquirer]
I once observed that federal judges are “the closest thing this nation has to an aristocracy.” If that’s the case, then justices of the United States Supreme Court are royalty — or maybe even deities, gods, and goddesses who walk among us (and occasionally crash into us, too).
Alas, it seems that two members of SCOTUS didn’t get the memo. They are comporting themselves in public in ways that are inconsistent with the dignity of the Article III judiciary.
This is a bipartisan problem. One of the offenders comes from the left side of the Court, and one comes from the right….
– Justice Antonin Scalia, in remarks made yesterday before the Senate Judiciary Committee. Justice Scalia and Justice Stephen G. Breyer were invited by the Committee to discuss their views on constitutional interpretation and the proper role of judges in our democracy.

My fellow Americans, I have some terrible news to tell you. I’ve just been made aware of a terrible secret. Apparently all the fears you’ve heard from the far right about the desire of certain liberal justices to impose foreign law on the Unites States of America were justified. I know, I know — I’m as shocked as you are.
I don’t know how else to make sense of what is going to happen tomorrow. The far, far right was right. They just got the kind of foreign law wrong. The Supreme Court doesn’t want to impose Sharia law on us; instead, they want to impose French law on us.
I know this because on Friday, July 22, Justice Stephen Breyer is going to go to that bastion of liberal elitism, Harvard Law School, and deliver an entire address in French. Sacré bleu!

A Supreme Court clerkship is, in the words of Adam Liptak of the New York Times, “the most coveted credential in American law.” When SCOTUS clerks leave their posts at the Court to join private law firms, they get signing bonuses of as much as $250,000 (on top of normal associate salaries and bonuses).
But typically they join their firms as associates (or maybe counsel, if they have a few extra years of practice in addition to clerking). How many clerks come in to Biglaw as partners?
As reported yesterday — by Tony Mauro in The BLT and by Marisa Kashino in Washingtonian magazine, among others — at least one Supreme Court clerk from the Term just ended, October Term 2009, is going to straight into a partnership at a major law firm.
Meet Elizabeth Papez. She clerked for Justice Clarence Thomas in OT 2009. Now she’s joining the D.C. office of Winston & Strawn, where she will practice in commercial and appellate litigation, with a focus on intellectual property and energy law, as well as government relations.

As we previously mentioned, and as Lawrence Hurley of the Daily Journal reports here, Congress is considering a proposal that would raise federal judges’ salaries by a significant margin. Here’s what the new scale would look like (with current salaries indicated parenthetically):
District Court Judges: $247,800 (up from $165,200) Court of Appeals Judges: $262,700 ($175,100) Associate Justices of the Supreme Court: $304,500 ($203,000) Chief Justice of the United States: $318,200 ($212,100)
This proposal would cost millions in taxpayer dollars. So we have a better solution to the problem of federal judicial pay, which Chief Justice John Roberts has dubbed a “constitutional crisis.”
Here’s our brilliant idea: Require all federal judges to marry rich!
Don’t you just love couples in which one spouse is a judge, with all the power and prestige of judicial office, and the other spouse is rolling in dough? Off the top of our head, we can name a number of federal judges who have married well — or at least wealthy. (Like Judge Kimba Wood, above right, with her well-heeled hubby, Frank Richardson.)

Since late last year, things have been booming in Hong Kong / China in cap markets, especially Hong Kong IPOs. M&A deal flow has recently been getting a bit stronger as well. Although one can’t predict such things with any certainty, all signs are pointing to a banner entire 2014 for the top end US corporate and cap markets practices in Hong Kong / China. This is not really new news, as its been the feeling most in the market have had for a few months now and things continue to look good.
The head of our Asia practice, Evan Jowers, has been in Hong Kong for about 10 days a month (with trips every other month to both Shanghai and Bejing) for the past 7 months (Robert Kinney and Evan Jowers will be in Hong Kong again March 15 to 23), and spending most of his time there meeting with senior US hiring partners at just about all the major US and UK firms there, as well as prospective candidates at all associate levels and partner levels, and when in the US, Evan works Asia hours and is regularly on the phone with such persons, as our the other members of our Asia team. Our Yuliya Vinokurova is in Hong Kong every other month and Robert is there about 5 times a year as well. While we have a solid Asia team of recruiters, Evan Jowers will spend at least some time with all of our candidates for Asia position. We have had long standing relationships, and good friendships in some cases, with hiring partners and other senior US partners in Asia for 8 years now.
