If law students want one thing in their grading system, it’s clarity. This is especially true for first-year law students; 1L grades are too important for future job prospects to have a confusing and muddled set of rules.
Well, maybe not Yale law students. Famously, Yale doesn’t have traditional letter grading. A few top schools have followed Yale’s lead in recent years, but Yale is the OG of meaningless grading systems. (Berkeley students to start bitching in 3, 2, 1….) The meaningless of Yale’s Honors/Pass grading system doesn’t matter because all Yale students get jobs. No grades + Good jobs = “I don’t understand why humans cry.”
Yale students have such good job prospects that they can get jobs as law professors at other Ivy League law schools right after they graduate from Yale. But bringing happy-clappy Yale concepts of grading to “normal” law schools is not without its problems….

If I were going to write an Onion-style parody of a Yale law professor defending the third year of law school in an op-ed, I wouldn’t come up with what Yale professor Bruce Ackerman just dropped on the Washington Post. It’s too on-the-nose to be funny as fiction. It’s too “exactly what I thought he would say” to qualify as parody. For the love of God, the man starts his defense of the third year of law school by quoting Oliver Wendell Holmes. He doesn’t start with employment statistics or any analysis of economic value or even a newstudy about the value of higher education generally. He’s a professor at the Yale Law School, so of course we’re starting with Holmes.
Since I’m not making it up, since a Yale Law School professor actually did write an op-ed about the current state of legal education in which his first reference is to a man who died in 1935, it’s freaking hilarious. I mean, thank God we have Yale law professors to reanimate Holmes so he can weigh in on our modern debate. When I asked old Ollie what he thought about the value of a law degree during a time of stagnant legal employment and skyrocketing tuition, he just told me, “My, you speak so well for a Negro. Since I’m sure society has evolved much since my death, I’m probably not the right guy to ask.”
Perhaps you remember them differently than I do. I remember a herd (and I don’t think it’s ungenerous to describe them thusly) parked at a table in our library. Bad skin, weight issues, nearsightedness — three-dimensional representations of a Far Side cartoon, hunched over the table in deep meditation. Wisecracks that weren’t wise at all bubbled up from the corners of the action. These were the jesters of this unfortunate royal court. And then suddenly! Action! One of the herd leaned over and subtly, but deftly, turned a stack of playing cards ever-so-slightly to the right. MAGIC!!!!!!???
Magic: The Gathering appeared at my high school seemingly out of nowhere. It appeared, to these eyes, to coalesce the scattered nerdery into a tight circle of “fun.” Lunches were now solemn affairs, after school was now not just a wasteland of sports and athletic enterprise. Time was filled with a card game that combined all the sexiness of Dungeons and Dragons with all of the mental dexterity of Go Fish. Pre-internet, you have to understand, this must have seemed like a godsend to those whose dance cards never involved dances.
And so it is that Magic: The Gathering reappeared on my radar this weekend as the New York Times ran a piece about its continuing popularity and recent beneficence. Specifically, the dorkiest game of all time is doing its part to make law school more affordable for the few, the proud, the Poindexters…

Depending on your jurisprudential leanings, you’ll be either moved, amused, or emotionally scarred by this wedding ceremony, which took place on the roof of the Cato Institute earlier this summer. Here’s the video. It gets a little weird when the groom whips out his pocket Constitution — he calls it “my Bible” — and vows to “faithfully execute the office of your husband.” (But keep watching for the bride’s vows, which are sweet and heartfelt.)

The law school brain drain is in full effect. Applications from Ivy League graduates are down, and applications are down in general. Last week, my colleague Elie Mystal described the troubling predicament like so: “[T]he students with the best ‘logical reasoning skills’ as measured by the LSAT are avoiding law school at a higher rate than people at shallow end of the LSAT pool.” That being the case, how have top law schools responded to the less than impressive talent pool? By doing the same thing they’ve always done.
Despite the fact that some of the most well-qualified students are fleeing the law school application game like rats from a sinking ship, T14 law schools are still attracting rather competitive applicants. Unlike the law schools that would reportedly consider admitting applicants with sub-145 LSAT scores, top schools would never deign to lower their elite standards — well, at least not by that much.
While it’s still difficult to get into a top law school, it’s not quite as difficult as it used to be before the bottom fell out from the entry-level employment market. What do top law schools’ LSAT scores look like now compared to three years ago? Let’s take a look…

Companies like Google, Microsoft, and Facebook have hired thousands of employees over the last decade by relying on brain teasers such as “Why are manhole covers round?” and “How would you weigh your head?” One psychology professor concluded last year that this sort of “puzzle interview is being used with greater frequency by employers in a variety of industries.” Earlier this week, however, a top human resources executive at Google reported that his company had scrapped the practice, offering the following admission: “brainteasers are a complete waste of time.” Google realized that its tests failed to identify the traits that correlate with success. For instance, Google now seeks managers who are “consistent and fair,” even if they aren’t good at estimating how many golf balls can fit inside a school bus.
Law firms are overdue for a similar reassessment of how they select junior associates. And as a corollary, law students should pay attention to the skills that law firms ask them about.
Let’s start with the employers. Several years ago, I organized a focus group of partners from top-10 Vault firms. I wanted to learn which skills Yale Law should emphasize as we continue to modernize the way that we train our students. The partners (including two corporate attorneys) all said that legal writing was the most important skill for junior associates.

If your firm is in ‘go’ mode when it comes to recruiting lateral partners with loyal clients, then take this quiz to see how well you measure up. Keep track of your ‘yes’ and ‘no’ responses.
1. Does your firm have a clearly defined strategy of practice groups that are priorities of growth for your office? Nothing gets done by random chance, but with a clear vision for the future. Identify the top practice areas for which you wish to add lateral partners. Seek input from practice group leaders and get specifics on needs, outcomes, and ideal target profiles.
2. In addition to clarifying your firm’s growth strategy, are you still open to the hire of a partner outside of your plan? I’ve made several placements that fit this category. The partner’s practice was not within the strategic growth plan of my client, but once the two parties started talking with each other, we all saw how it could indeed be a seamless fit. Be open to “Opportunistic Hires.” You never know where your next producing partner might come from, so you have to be open to it. I will be the first to admit that there is a quirky element of randomness in recruiting.
