Pregnancy Discrimination Lawsuit Against MoFo Spirals And Gets Yet Another Plaintiff

MoFo has mo' plaintiffs to deal with in this pregnancy discrimination lawsuit.

The pregnancy and gender discrimination lawsuit against the noted Biglaw firm of Morrison & Foerster just keeps on snowballing. It was back in April of 2018, that three Jane Does first sued MoFo as part of a $100 million class-action case alleging gender discrimination as women at the firm that take maternity leave are placed on a “mommy track” which negatively impacted their careers. Then, in January, an amended complaint was filed that added three more Jane Doe plaintiffs. Now an additional plaintiff has come forward.

Jane Doe 7, who was added in this second amended complaint, worked in the New York office of MoFo until September 2016. Jane Doe 7 alleges she had excellent work reviews until she took the first of two maternity leaves. When she returned from that first leave on a reduced schedule, she says she received her first negative performance review and was allegedly told, “she did not seem ‘committed enough’ to the firm.”

As reported by Law.com, it wasn’t until after her second maternity leave that she was ultimately forced out of the firm:

Following her second leave period, the suit alleges that Jane Doe 7 saw partners on her team divert chances to do meaningful work to male associates. About three months after she returned, Morrison & Foerster allegedly informed her that it was time for her to move on. The firm offered her a choice between a two-month probation period in which she could prove her commitment or ultimately be fired, or a three-month window in which she could look for other employment before resigning from the firm.

MoFo continues to strongly contest the allegations in the amended complaint:

“Nothing in plaintiffs’ filing of an amended complaint changes the fact that their allegations are baseless. We are confident in our defense,” the statement said. “We will continue to be one of the top family-friendly law firms, and our diversity and inclusion remains one of our proudest achievements and greatest priorities.”
