Clearly, mobile security isn\u2019t always front-of-mind for lawyers.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Understandably, information governance isn\u2019t exactly a big part of the law school curriculum. But with high-profile data breaches affecting law firms regularly making the news, as well as the wealth of confidential client data firms are sitting on, lawyers can no longer afford to sit idly by and hope for the best.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Mobile lawyering offers a range of benefits, but in order for your mobile practice to be successful &#8212; and ethical &#8212; you need to ensure your mobile device is secure.<\/span><\/p>\n<p><span style=\"font-weight: 400\">We feel very strongly about security at Clio. To protect user data:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">We\u2019re audited every day by McAfee Secure to help ensure your data is protected from security vulnerabilities and other online threats.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Our privacy policy has been reviewed by TRUSTe for compliance with their program requirements, including transparency, accountability, and choice related to the collection and use of your Personal Information.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">All information traveling between your browser and Clio is protected with 256-bit Secure Sockets Layer (SSL) encryption, and is validated by Norton Secured by Symantec.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">We have multiple servers backing up your data in real time to provide geographic redundancy (i.e., if a server in one location fails, the server in the other location will still keep your data intact).<\/span><\/li>\n<li style=\"font-weight: 400\"><a href=\"http:\/\/bit.ly\/2gYCVi3\"><span style=\"font-weight: 400\">And more<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">However, there\u2019s a limit to what your legal practice management provider can do to protect your data &#8212; there are also key steps you need to take yourself.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It\u2019s your practice on the line, so please take action on the tips in this list immediately if you have not done so already.<\/span><\/p>\n<p><b>The importance of mobile security for lawyers<\/b><\/p>\n<p><span style=\"font-weight: 400\">Joe Kelly wrote an article with <\/span><a href=\"http:\/\/bit.ly\/2fJ4BY8\"><span style=\"font-weight: 400\">Law Technology Today<\/span><\/a><span style=\"font-weight: 400\"> suggesting that lawyers specifically are doing many things to compromise their firm\u2019s security. These include opening attachments from unknown senders, using poor software solutions, and storing unencrypted firm data directly on their devices.<\/span><\/p>\n<p><span style=\"font-weight: 400\">That\u2019s a problem, as cyber threats are on the rise for mobile devices. A <\/span><a href=\"http:\/\/bit.ly\/2gpE412\"><span style=\"font-weight: 400\">Nokia report<\/span><\/a><span style=\"font-weight: 400\"> released earlier this year looked at malware infection rates across all mobile devices, and found that the number of malware infections that took place in the first half of 2016 doubled compared to the second half of 2015. Android phones (74 percent) were mostly at risk, but Apple (4 percent) and Windows devices (22 percent) weren\u2019t safe either.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In fact, many of the greatest cyber threats <\/span><a href=\"http:\/\/on.inc.com\/2gbHkdH\"><span style=\"font-weight: 400\">target mobile devices<\/span><\/a><span style=\"font-weight: 400\"> specifically, with attacks designed to track location and monitor text messages, emails, and even screen activity.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But it\u2019s not just malware that puts firms at risk. Mobile devices are easy to misplace or leave behind &#8212; and they\u2019re easy to conceal. With just one moment of absentmindedness, you could forget your phone or tablet in a cab, leaving your clients\u2019 data vulnerable. <\/span><\/p>\n<p><span style=\"font-weight: 400\">This is more common than you might think. According to a<\/span><a href=\"http:\/\/bit.ly\/2fPjdAw\"><span style=\"font-weight: 400\"> report from Bitglass<\/span><\/a><span style=\"font-weight: 400\">, 25.3 percent of data breaches in the financial services sector since 2006 have been a result of lost or stolen devices.<\/span><\/p>\n<p><b>Tips to secure your mobile phone<\/b><\/p>\n<p><span style=\"font-weight: 400\">\u201cTips\u201d might actually be a bit of a misnomer. Without taking the proper precautions, lawyers who work on mobile devices may be be inadvertently leaving confidential client information at risk of public exposure.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, by taking a few key steps &#8212; and by keeping a few rules in mind &#8212; you can secure your mobile devices and know you\u2019re keeping client data safe.<\/span><\/p>\n<p><b>1. Use common sense<\/b><\/p>\n<p><span style=\"font-weight: 400\">This might seem fairly straightforward, but it\u2019s worth mentioning: Be careful when working with client information in public. This alone will go a long way towards keeping your mobile device secure.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Don\u2019t speak loudly about the details of a case, and don\u2019t work where others can easily look over your shoulder (you never know, opposing counsel could be sitting right behind you).<\/span><\/p>\n<p><b style=\"font-family: inherit;font-size: 1rem\">2. Password protect your phone<\/b><\/p>\n<p><span style=\"font-weight: 400\">And your tablet. And your laptop.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is a basic first step, and you need to do it <\/span><b>now<\/b><span style=\"font-weight: 400\"> if you haven\u2019t already.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Which brings us to step three\u00a0&#8230;<\/span><\/p>\n<p><b>3. Use strong passwords<\/b><\/p>\n<p><span style=\"font-weight: 400\">Your password shouldn\u2019t be your first name, or 1234, or anything else that someone trying to get access to your data could easily guess. Ideally, your password should have:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A mix of numbers and upper and lower case letters <\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">More than 12 characters<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">No dictionary words (better: no words at all)<\/span><\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-444866 aligncenter\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2016\/12\/Screen-Shot-2016-12-01-at-9.40.28-AM-300x150.png\" alt=\"screen-shot-2016-12-01-at-9-40-28-am\" width=\"350\" height=\"175\" \/><\/p>\n<p><span style=\"font-weight: 400\">A password manager, such as <\/span><a href=\"http:\/\/bit.ly\/2gK9Bvi\"><span style=\"font-weight: 400\">KeePass<\/span><\/a><span style=\"font-weight: 400\">, can help you keep track of tough passwords.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ideally, you should also be changing your passwords often. This way, if someone <\/span><i><span style=\"font-weight: 400\">does<\/span><\/i><span style=\"font-weight: 400\"> get a hold of your password, they won\u2019t have access to your account for long.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In Clio, you can require that users use strong passwords, and you can set these passwords to expire after a given amount of time. Monthly, for example.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-444867 aligncenter\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2016\/12\/Screen-Shot-2016-12-01-at-9.41.47-AM-300x311.png\" alt=\"screen-shot-2016-12-01-at-9-41-47-am\" width=\"321\" height=\"333\" \/><b style=\"font-family: inherit;font-size: 1rem\"><\/b><\/p>\n<p><b style=\"font-family: inherit;font-size: 1rem\">4. Use two-factor authentication<\/b><\/p>\n<p><span style=\"font-weight: 400\">Even the strongest passwords can be hacked. That\u2019s why it\u2019s a good idea to enable two-factor authentication for an extra layer of security for all your accounts.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Two-factor authentication requires not only your password, but a temporary code that gets sent to your mobile device as well, via text message, or via the <\/span><a href=\"http:\/\/bit.ly\/2gMiZw8\"><span style=\"font-weight: 400\">Google Authenticator app<\/span><\/a><span style=\"font-weight: 400\">. The codes usually only last 10\u201315 seconds before a new one is required. If a person trying to access your account guesses your password, but they don\u2019t have your mobile phone, they won\u2019t be able to access your account.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-444868 aligncenter\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2016\/12\/Screen-Shot-2016-12-01-at-9.42.29-AM-300x455.png\" alt=\"screen-shot-2016-12-01-at-9-42-29-am\" width=\"300\" height=\"455\" \/><\/p>\n<p><span style=\"font-weight: 400\">While we say \u201cextra layer of security,\u201d the practice of adding two-factor authentication is actually becoming fairly standard. In fact, <\/span><b>as of November 15, Clio will require that all users use two-factor authentication to access their accounts<\/b><span style=\"font-weight: 400\"> (we\u2019re removing the ability to access accounts with email verification codes, as this is not secure enough).<\/span><\/p>\n<p><b style=\"font-family: inherit;font-size: 1rem\">5. Encrypt your devices<\/b><\/p>\n<p><span style=\"font-weight: 400\">Encryption might sound technical, but it\u2019s actually fairly easy to encrypt your mobile device.<\/span><\/p>\n<p><span style=\"font-weight: 400\">First, make sure you have a lock-screen password (see notes on strong passwords above). This is your first line of defense &#8212; if someone gets a hold of your device, they won\u2019t be able to access it without your password.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Second, enable encryption on your device. It\u2019s simple: Just follow the steps on your provider\u2019s website:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><a href=\"http:\/\/zd.net\/2gpRR7W\"><span style=\"font-weight: 400\">iPhone encryption steps<\/span><\/a><\/li>\n<li style=\"font-weight: 400\"><a href=\"http:\/\/bit.ly\/2fJaMeV\"><span style=\"font-weight: 400\">Nexus phone encryption steps<\/span><\/a><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">If you have an Android device, instructions will vary depending on the phone you have. Look how to turn on encryption on the phone manufacturer\u2019s website, or simply search online for articles outlining the steps (here are the steps for a <\/span><a href=\"http:\/\/bit.ly\/2gpLhhS\"><span style=\"font-weight: 400\">Samsung S6<\/span><\/a><span style=\"font-weight: 400\">).<\/span><\/p>\n<p><b>If you haven\u2019t done this yet, do it now. Right now.<\/b><\/p>\n<p><span style=\"font-weight: 400\">Don\u2019t stop at your mobile device. Encrypt your laptop hard drives and USB drives as well:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Encrypt your Mac\u2019s hard drive by <\/span><a href=\"http:\/\/apple.co\/2gYLwBz\"><span style=\"font-weight: 400\">turning on FileVault<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Encrypt your PC hard drive by using the professional version of Windows (device encryption should be automatically enabled, but you can double check with <\/span><a href=\"http:\/\/bit.ly\/2gCOKHy\"><span style=\"font-weight: 400\">these steps<\/span><\/a><span style=\"font-weight: 400\">).<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Encrypt USB drives using <\/span><a href=\"http:\/\/bit.ly\/2gMhwpy\"><span style=\"font-weight: 400\">Bitlocker<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Finally, for an extra layer of security, you can use <\/span><a href=\"http:\/\/bit.ly\/2fPjFyI\"><span style=\"font-weight: 400\">CloudMask<\/span><\/a><span style=\"font-weight: 400\">. Even in the event of a data breach, data that has been \u201cmasked\u201d by CloudMask remains protected, meaning that you can rest easy even in a worst-case scenario.<\/span><\/p>\n<p><span style=\"font-weight: 400\">To be clear, if you\u2019re using cloud-based tools on your mobile devices &#8212; such as a cloud-based practice-management solution like Clio &#8212; your data <\/span><i><span style=\"font-weight: 400\">will<\/span><\/i><span style=\"font-weight: 400\"> be extremely secure (see the measures we take above). For some, it simply might provide additional piece of mind to invest in another security tool.<\/span><\/p>\n<p><b style=\"font-family: inherit;font-size: 1rem\">6. \u00a0Communicate via secure channels<\/b><\/p>\n<p><span style=\"font-weight: 400\">Now that you\u2019ve encrypted all of your mobile devices, you\u2019ll need to make sure you\u2019re communicating via secure channels as well.<\/span><\/p>\n<p><span style=\"font-weight: 400\">When sending client data back and forth, unencrypted messages and emails are vulnerable to interception. It\u2019s best to use a secure portal like <\/span><a href=\"http:\/\/bit.ly\/2fPjgMN\"><span style=\"font-weight: 400\">Clio Connect<\/span><\/a><span style=\"font-weight: 400\"> to share client information, and a secure messaging app like the Signal App from <\/span><a href=\"http:\/\/bit.ly\/2gCOTKQ\"><span style=\"font-weight: 400\">Open Whisper Systems<\/span><\/a><span style=\"font-weight: 400\"> to send short messages.<\/span><\/p>\n<p><b style=\"font-family: inherit;font-size: 1rem\">7. Have a BYOD policy<\/b><\/p>\n<p><span style=\"font-weight: 400\">If you\u2019re working with partners, associates, or staff, they may be using their personal mobile devices to do work and access firm data. You need a Bring Your Own Device (BYOD) policy to govern how this works &#8212; and what to do in the event of a data security breach.<\/span><\/p>\n<p><span style=\"font-weight: 400\">At a minimum, your policy should require that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b>All lawyers and staff use firm-specified services to work with client data.<\/b><span style=\"font-weight: 400\"> There are over 2 million apps out there, many of which can help make your working life easier. But not all are safe to use with client data. Choose wisely, and make sure the rest of your firm respects those choices.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>All devices have a remote wipe option enabled.<\/b><span style=\"font-weight: 400\"> If someone steals your paralegal\u2019s phone, what do you do? You need to be able to remotely wipe all data from the device to protect sensitive client information.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>All devices are encrypted.<\/b><span style=\"font-weight: 400\"> Again, this is super important. You should encrypt data on any and every device you work with client data on?<\/span><\/li>\n<\/ul>\n<p><b>8. Keep apps and operating systems up to date<\/b><\/p>\n<p><span style=\"font-weight: 400\">Older apps and operating systems are more vulnerable to attack. Consider: Israel\u2019s NSO group was at one point selling software that could <\/span><a href=\"http:\/\/nyti.ms\/2fVDzLx\"><span style=\"font-weight: 400\">spy on iPhones without being detected<\/span><\/a><span style=\"font-weight: 400\">. Passwords, emails, text messages, phone calls, and even the location of the phone were all put at risk &#8212; for those who hadn\u2019t upgraded their iOS software.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Always. Update. Your. Apps.<\/span><\/p>\n<p><b>9. Back up firm data<\/b><\/p>\n<p><span style=\"font-weight: 400\">Finally, always back up your firm data to an encrypted location. This way, you\u2019ll have access to most of your data in the event of a ransomware attack.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ransomware infects your computer and encrypts all of its data. A hacker then demands payment to unencrypted the data. <\/span><i><span style=\"font-weight: 400\">Maybe<\/span><\/i><span style=\"font-weight: 400\"> they\u2019ll actually unencrypt the data if you pay them. Maybe not.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In addition to keeping your firm\u2019s data more secure, this will provide a backup in the event that your phone and laptop happen to die on the same day. Backups should be done weekly, at a minimum, and should ideally be automated.<\/span><\/p>\n<p><span style=\"font-weight: 400\">These steps are a great starting point for keeping your mobile law firm secure, and you should <\/span><b>definitely take action on all of them now to ensure your client data is protected<\/b><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">That said, make sure to do your own research and find other ways of keeping your mobile practice secure as well.
