Indeed, from March 13 \u2013 just before most lockdown orders \u2013\u00a0 to March 30, the number of Americans working remotely doubled, from 31 percent to 62 percent, according to <\/span><a href=\"https:\/\/news.gallup.com\/poll\/306695\/workers-discovering-affinity-remote-work.aspx\"><span style=\"font-weight: 400\">Gallup<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Of course, it\u2019s not the traditional work-from-home situation: <\/span><a href=\"https:\/\/news.gallup.com\/poll\/305819\/parents-worry-covid-affect-child-education.aspx\"><span style=\"font-weight: 400\">Gallup<\/span><\/a><span style=\"font-weight: 400\"> found 70 percent of U.S. parents are homeschooling, too, making it challenging, if not impossible, to maintain a typical schedule.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Whether you are a parent trying to work without childcare or a new telecommuter adjusting to a makeshift office (or maybe both), these times call for a lot of grace, a lot of patience\u2026.and a lot of flexibility.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Flexwork was sprung upon most of us in March and April, but it may be here to stay: In that first Gallup survey, nearly 60 percent of workers said they would try to work remotely \u201cas much as possible\u201d after restrictions on businesses are lifted. Savvy Legal Departments can use this forced Flexwork to experiment, to learn, and to emerge with forward-thinking flexible work arrangements.<\/span><\/p>\n<p><b>What is Flexwork?<\/b><\/p>\n<p><span style=\"font-weight: 400\">The University of Washington provides <\/span><a href=\"https:\/\/hr.uw.edu\/policies\/flexwork\/\"><span style=\"font-weight: 400\">a simple definition<\/span><\/a><span style=\"font-weight: 400\">: Flexwork is any work plan that differs from the \u201cstandard workweek\u201d of five consecutive eight-hour days with consistent start\/stop times.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Before the coronavirus, a study by <\/span><a href=\"https:\/\/worklifelaw.org\/publications\/StillBetter_FINAL.pdf\"><span style=\"font-weight: 400\">The Project for Attorney Retention<\/span><\/a><span style=\"font-weight: 400\"> found that 14 percent of in-house legal departments offered \u201cpolicies that create a more flexible work structure.\u201d By contrast, 40 percent of legal departments ran on the traditional corporate model of five 10-hour(ish) days, and 30 percent emulated law firm life \u2013 \u201clong hours, interrupted vacations, and the like.\u201d<\/span><\/p>\n<p><b>How Does It Work?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Unlike more process-oriented working methods (such as <\/span><a href=\"https:\/\/gutenberg-atl.staging.breakingmedia.com\/legal-innovation-center\/2020\/05\/05\/new-ways-of-working-part-2-meet-lean-six-sigma\/\"><span style=\"font-weight: 400\">Lean Six Sigma<\/span><\/a><span style=\"font-weight: 400\">, which we profiled last time), Flexwork doesn\u2019t require a major shift in how you handle matters. In non-pandemic times, Flexwork stems from a tacit agreement with individuals that their work will get done \u2013 just not necessarily on a traditional timeframe.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Flexwork options used by in-house lawyers, as reported by The Project for Attorney Retention:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Telecommuting (formal and ad hoc) \u2013 64 percent<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Flexible start-stop times \u2013 61 percent<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Compressed workweek (e.g., four 10-hour days) \u2013 8 percent<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Job sharing \u2013 1 percent<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">When asked what Flexwork options are the most helpful, flexible start\/stop times was No. 1, with 74 percent \u2013 and again, that\u2019s before COVID-19. Notably, it also ranked No. 1 when respondents with no Flexwork options were asked what they would be most likely to use.<\/span><\/p>\n<p><b>Who Does It Work For?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Between laptops and cloud resources, such as matter management software, most legal department personnel are well-suited for flextime from a practical standpoint.<\/span><\/p>\n<p><span style=\"font-weight: 400\">From a cultural standpoint\u2026 that\u2019s another matter. In a department or organization where \u201cface time\u201d is highly valued, expectations to adhere to the 9-to-5 norm may discourage the use of Flexwork options even when offered. Indeed, The Project for Attorney Retention study asked respondents to rate the career compromise associated with various Flexwork policies; they said every option would have at least a slight effect, with some impacting their careers \u201ca great deal.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Only one-third said their company\u2019s executive management was \u201cvery supportive\u201d of their work-life needs.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is one area where the coronavirus crisis may give us an opportunity to grow as a profession: Everyone is Flexworking right now, and most are functioning quite well. As we get \u201cback to normal,\u201d let\u2019s remember this \u2013 and let go of our collective baggage surrounding the traditional workday. (This issue hits home for me; in 2012, I built <\/span><a href=\"https:\/\/hivelegal.com.au\/how\/\"><span style=\"font-weight: 400\">Hive Legal<\/span><\/a><span style=\"font-weight: 400\">, a law firm built on remote working and flexible scheduling. I know it works \u2013 for lawyers and for clients.)<\/span><\/p>\n<p><b>What Do You Need?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Culture issues aside, Flexwork is easy to implement \u2013 although it can be chaotic when unplanned, as we all now know.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Under normal conditions, Flexwork is best with:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b>Hardware.<\/b><span style=\"font-weight: 400\"> Team members who work from home should have requisite equipment, including laptops, monitors, printers, et cetera. Consult your IT and HR departments to determine what could be loaned or reimbursed.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Software.<\/b><span style=\"font-weight: 400\"> Team members should have access to the full suite of department resources, from document management to research.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Visibility. <\/b><span style=\"font-weight: 400\">It\u2019s critical that those working on a different schedule or in a different setting not be out of sight, out of mind \u2013 and it\u2019s critical that others in the department are well-versed on the status of their projects. Maintain regular department \u201cmeetings,\u201d even if done by Zoom, Teams or phone. A cloud-based matter management system, like Xakia, can provide easy access to \u201cwho\u2019s doing what,\u201d and when it\u2019s needed.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Set expectations.<\/b><span style=\"font-weight: 400\"> The foundation of Flextime is, well, flexibility, but relationships with both the department and the business clients depend on reliability. Establish times when you will be accessible; share your schedule; and make use of out-of-office messages to provide alternative contacts in case of emergencies.<\/span><\/li>\n<\/ul>\n<p><b>Can You Start During COVID-19?<\/b><\/p>\n<p><span style=\"font-weight: 400\">Most of us already have!
