I have identified five trends, which I have divided into three categories: unforeseeable, continuing and surprising.<\/p>\n<p>The trends I believe are worth noting &#8212; Unforeseeable: COVID-19 impacts; Predicable: state court analytics and innovative workflow tools; Surprising: legal news re-emerges as a competitive focus among major legal publishers and tech marketplaces emerge.<\/p>\n<p><strong>Unforeseeable: COVID-Related Trends<\/strong><\/p>\n<p>COVID alone triggered four subtrends:<\/p>\n<ul>\n<li>The emergence of local law and ephemeral publications. Major legal vendors were no more prepared to track county level health department issuances and Governors\u2019 executive orders than the average law firm. To make things worse these \u201cdocuments\u201d were issued in a myriad of social media formats, texts, tweets, Facebook pages \u2026 . What\u2019s a law firm to do?<\/li>\n<li>Librarians and KM professionals stepped into the vacuum and established protocols for locating and harnessing the untidy universe of COVID-19 ephemera.<\/li>\n<li>Law firms became publishers of original COVID-19 resources (leveraging the local documents harnessed by librarians).<\/li>\n<li>Legal publishers turned put an unprecedent volumes of free legal resources covering COVID-19 issues. I covered this trend in an earlier ATL<a href=\"https:\/\/abovethelaw.com\/2020\/03\/legal-publishers-roll-out-covid-19-resources-toolkits-alerts-advice-some-even-free\/\"> post<\/a>.<\/li>\n<\/ul>\n<p><strong>Continuing Trends: State Court Analytics And Workflow Tools<\/strong><\/p>\n<p><em>State Litigation Analytics &#8212;<\/em> California was ground zero for the development of federal and state analytics. <a href=\"http:\/\/www.gavelytics.com\">Gavelytics<\/a> and <a href=\"http:\/\/www.judicata.com\">Judicata<\/a> were two of the earliest startups to tackle the challenges of state litigation analytics. <a href=\"http:\/\/www.lexmachina.com\">Lex Machina<\/a>, the pioneer in federal litigation analytics, entered the state litigation analytics market with the February launch of California and Nevada modules.<\/p>\n<p><a href=\"http:\/\/www.westlaw.com\">Westlaw<\/a> and <a href=\"http:\/\/www.blaw.com\">Bloomberg Law<\/a> which previously launched \u00a0state analytics continues to build out state analytics content. Starts-ups <a href=\"https:\/\/trellis.law\/\">Trellis<\/a> and <a href=\"https:\/\/unicourt.com\/?utm_source=google&amp;utm_medium=cpc&amp;utm_campaign=branded-exact&amp;keyword=unicourt&amp;adgroupid=47291762851&amp;device=c&amp;gclid=Cj0KCQiAifz-BRDjARIsAEElyGL9q5zrK9sA5rMb_CWHoQJkmf2GRTW38GCIV5CYhtkJ6lEDcKyokc8aArleEALw_wcB\">Unicourt<\/a> joined the state analytics party in 2020. <a href=\"http:\/\/www.fastcase.com\">Fastcase\/DocketAlarm<\/a> continued building out their state litigation analytics and late in the year announced the acquisition of Judicata.<\/p>\n<p><strong>Workflow Tools<\/strong><\/p>\n<ul>\n<li><em>Brief Analysis tools<\/em>. <a href=\"http:\/\/www.casetext.com\">Casetext<\/a> launched a groundbreaking AI-enabled motion-drafting tool, <a href=\"https:\/\/compose.law\/\">Compose<\/a>, at the Legal Tech conference in January. Compose uses AI to identify legal arguments and standards tailored to a jurisdiction and legal issue. Parallel search turbocharges the location of relevant precedent to support arguments.<\/li>\n<li>Casetext had invented a new class of brief checking tool with the launch of CARA in 2016. \u00a0It has taken a few years for all of the larger tech companies to catch up. <a href=\"http:\/\/lexisnexis.custhelp.com\/app\/answers\/answer_view\/a_id\/1102030\/~\/%E2%96%B6%EF%B8%8F-using-brief-analysis-on-lexis%2B#:~:text=Brief%20Analysis%20on%20Lexis%2B%E2%84%A2,help%20you%20build%20stronger%20arguments.&amp;text=Graphical%20and%20non%2DOCR%20PDFs,scanned%20documents%2C%20are%20not%20supported.\">LexisNexis<\/a> and <a href=\"https:\/\/pro.bloomberglaw.com\/brief-analyzer\/\">Bloomberg Law<\/a> launched their brief analyzer tools in 2020. Westlaw launched their brief analyzer tool <a href=\"https:\/\/legal.thomsonreuters.com\/en\/products\/westlaw\/edge\/quick-check?searchid=TRPPCSOL\/Google\/LegalUS_LI_Westlaw_Quick-Check_Search_Brand-Exact_US\/QuickCheck-Exact&amp;chl=ppc&amp;cid=9009877&amp;sfdccampaignid=7011B000002hUywQAE&amp;ef_id=Cj0KCQiAifz-BRDjARIsAEElyGLKR1i8ZL5Jiw23f2lvNjsnI4uXmqy2MxUzCHipxzmjF6f_LkAPAhAaAh_UEALw_wcB:G:s&amp;s_kwcid=AL!7944!3!362686562823!e!!g!!westlaw%20quick%20check&amp;gclid=Cj0KCQiAifz-BRDjARIsAEElyGLKR1i8ZL5Jiw23f2lvNjsnI4uXmqy2MxUzCHipxzmjF6f_LkAPAhAaAh_UEALw_wcB\">Quick Check<\/a> in \u00a0 That product was leveraged to build <a href=\"https:\/\/www.thomsonreuters.com\/en\/press-releases\/2020\/august\/thomson-reuters-adds-quick-check-judicial-to-westlaw-edge.html\">Quick Check Judicial<\/a>. This is a tool was created for judges and can analyze up to six documents and produce comparative reports.<\/li>\n<li>Among the other workflow tools launched in 2020: Wolters Kluwer added a <a href=\"https:\/\/www.wolterskluwer.com\/en\/news\/wolters-kluwer-launches-new-practical-content-solution-for-legal-professionals\">Practical Content dashboard<\/a> and <a href=\"https:\/\/www.thomsonreuters.com\/en\/press-releases\/2020\/august\/unveiling-a-new-version-of-thomson-reuters-highq.html\">Thomson Reuters HiQ 5.4<\/a> AI contract analysis with integration to\u00a0 Contract Express.<\/li>\n<\/ul>\n<p><strong>Surprising Trends: Legal News And Technology Directories<\/strong><\/p>\n<p><em>Is the Lexis News Monopoly In Jeopardy?<\/em> If you look at 2020 trends &#8212; the answer is \u201cyes.\u201d Lexis has owned a virtual monopoly on legal news for the past decade. They not only bought Law360 in 2012, but over the years have locked up exclusive deals with the Wall Street Journal and American Lawyer Media. In 2014 they bought the news aggregation platform Newsdesk. I have repeatedly wondered aloud why Thomson Reuters and Bloomberg &#8212; both media companies &#8212; have failed to compete directly with Law360.<\/p>\n<p>In January, Fastcase and American lawyer Media both announced the launch of legal news products.<\/p>\n<ul>\n<li><strong>Fastcase<\/strong> launched their first <strong><a href=\"https:\/\/www.fastcase.com\/blog\/fastcase-relaunches-law-street-media\/\">Law Street Media<\/a> <\/strong>newsletter which provides not only news but weaves analytics from their Docket Alarm analytics product into the news.<\/li>\n<li><strong>ALM<\/strong> announced an innovative news feed <strong>Legal Radar<\/strong> now branded as <a href=\"https:\/\/www.alm.com\/press_release\/alm-announces-the-launch-of-law-com-radar\/\"><strong>Law.com Radar<\/strong>.<\/a> It offers a \u201cbreaking\u201d newsfeed directed at younger lawyers who consume news on their phones. News items are referred to as \u201cblips.\u201d After originally focusing on Litigation news, they added \u201cbreaking deal\u201d news for transactional lawyers in November.<\/li>\n<li><strong>Thomson Reuters<\/strong> Back in March 2020 I met with Tony Kinnear, the new President of Thomson Reuters Legal Professions. My message to Kinnear \u2013 Thomson Reuters needs to compete with Law360. It may be a coincidence, but in October 2020 Thomson Reuters launched a legal news product <a href=\"https:\/\/legal.thomsonreuters.com\/en\/products\/westlaw-today\"><strong>Westlaw Today<\/strong><\/a>.<\/li>\n<li><strong>Bloomberg Law<\/strong> solidified their place in legal news with the acquisition of the Bureau of National Affairs in 2011. I once described BNA as the nerd \u201cA+ student in a bow tie\u201d of legal publishing. Since his appointment in 2018, Bloomberg Law President Joe Breda has been focused on transforming the company\u2019s historically dense, regulatory news offerings into more modern stream-able, clickable and contextualized <a href=\"https:\/\/pro.bloomberglaw.com\/law-news\/?trackingcode=BLAW204639&amp;utm_medium=paidsearch&amp;utm_source=google&amp;gclid=Cj0KCQiAifz-BRDjARIsAEElyGLAQuW3ej0YC-XggUYVGNuRdMDcgBJ5LSHQvEUZCWccuMBtjIgEePgaAnnNEALw_wcB\">legal news<\/a> products. This past year they added embedded interactive visualizations including law firm rankings and hired an Editor-in-Chief from the National Law Journal.<\/li>\n<\/ul>\n<p><strong>Tech Marketplaces<\/strong><\/p>\n<p>First of all it needs to be stated that marketplaces are basically curated directories. \u00a0Some also offer cloud environments where new products can be tested. I didn\u2019t see this coming at all and yet, I have a visceral understanding of why Marketplaces are needed. A Google search for something like \u201clegal practice management tools\u201d can deliver 8 million useless results in a second. You are better off emailing your colleagues for product recommendations. What is a lawyer\/technologies\/librarian to do? Enter the Tech Marketplace.<\/p>\n<ul>\n<li><a href=\"https:\/\/reynencourt.com\/\">Reynen Court<\/a> created by a consortium of law firms is a type of legal app store launched in January with a mission: \u00a0\u201cto make it easier for law firms and legal departments to adopt and manage modern cloud-based software applications without having to trust firm or client content to the rapidly growing universe of vertically integrated SaaS providers.\u201d<\/li>\n<li><a href=\"https:\/\/www.thomsonreuters.com\/en\/products-services\/legal.html\">Thomson Reuters <\/a>announced\u00a0 two initiatives.\u00a0<a href=\"https:\/\/bit.ly\/trmktplc\">Thomson Reuters Marketplace<\/a> (beta version), is an online marketplace where lawyers, technologists and knowledge professional can research, trial and purchase a wide range of Thomson Reuters solutions. <a href=\"https:\/\/bit.ly\/trlegalhome\">Thomson Reuters Legal Home<\/a>\u00a0\u00a0is described as an \u201cintegrated digital launchpad\u201d where subscribers can access their Thomson Reuters products as well as information about external products which can be integrated with or linked to Thomson Reuters products.<\/li>\n<li>The law firm Orrick Herrington &amp; Sutcliffe launched <a href=\"https:\/\/www.orrick.com\/en\/Innovation\/Observatory\">The Observatory<\/a>, \u201can interactive platform offering data on 600+ legal technologies in the market today. Created by Orrick\u2019s Innovation Team, The Observatory plainly describes what each technology does and includes data on management diversity to help legal departments enhance focus on vendor equity.\u201d<\/li>\n<li><a href=\"https:\/\/legaltechnologyhub.com\/\"><strong>LegaltechHub <\/strong><\/a>This past fall, husband and wife tech team Chris Ford and Nikki Shaver launched an important new technology resource:\u00a0<a href=\"https:\/\/legaltechnologyhub.com\/how-lth-works\">com<\/a>. Legaltechhub (LTH) is a curated database of legal technology tools, which is enhanced with extensive and careful tagging and taxonomy of more than 600 legal technology products.<\/li>\n<\/ul>\n<p><strong>2020 Trends in Context. Competition drives innovation.<\/strong> The ongoing expansion of state court judicial analytics products are important not only for the practice of law but for the impact such data can have on access to justice. Workflow tools free lawyers to focus on higher level analysis and provide quality assurance checks. Competition in the Legal news space is long overdue. \u00a0Tech marketplaces offer a win-win for vendors and law firm customers. Products can more easily be located and tested and technology and knowledge processionals can more easily assess the marketplace and determine what technologies exist and what needs a custom in house solution. Will the emergence of ephemeral law law during COVID result in a long term change in legal publishing? I don\u2019t see any signs of that so far. No major publisher has announced a commitment to ongoing collection of local materials.
