And they didn\u2019t want to talk much about it because they know that the privacy standards and oversight of the entire US snoopvertising economy, from\u00a0<a href=\"https:\/\/www.techdirt.com\/2020\/09\/09\/if-were-so-worried-about-tiktok-why-arent-we-just-as-worried-about-adtech-location-data-sales\/\">adtech<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.techdirt.com\/2018\/05\/21\/nearly-everyone-us-canada-just-had-their-private-cell-phone-location-data-exposed\/\">telecom<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/05\/02\/grindr-the-latest-company-caught-selling-detailed-user-location-data\/\">app makers<\/a>,\u00a0<a href=\"https:\/\/www.vice.com\/en\/article\/qjkp57\/leaked-videos-show-disney-is-the-biggest-ad-tech-giant-youve-never-heard-of\">media giants<\/a>, and the\u00a0<a href=\"https:\/\/www.techdirt.com\/2016\/07\/26\/internet-things-is-security-privacy-dumpster-fire-check-is-about-to-come-due\/\">internet of things<\/a>\u00a0\u2014 is an unaccountable dumpster fire.<\/p>\n<p>Concerns about things like the widespread abuse of\u00a0<a href=\"https:\/\/www.techdirt.com\/2018\/05\/21\/nearly-everyone-us-canada-just-had-their-private-cell-phone-location-data-exposed\/\">location<\/a>, clickstream, or behavioral data were routinely dismissed before hardline authoritarianism came to the United States. You couldn\u2019t step a foot in any direction without seeing a white male tech insider insisting that you don\u2019t need to meaningfully reform privacy and privacy oversight, because\u00a0<em>consumers don\u2019t actually care<\/em>\u00a0about privacy:<\/p>\n<div class=\"responsive-embed\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">just thinking today about how the people who have spent the past decade-plus insisting &quot;no one really cares about online privacy&quot; were so often men <a href=\"https:\/\/t.co\/SDrl5CulFH\">pic.twitter.com\/SDrl5CulFH<\/a><\/p>\n<p>&mdash; Will Oremus (@WillOremus) <a href=\"https:\/\/twitter.com\/WillOremus\/status\/1540376764677070850?ref_src=twsrc%5Etfw\">June 24, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p><span style=\"font-family: inherit;font-size: 1rem\">With the potential that women\u2019s browsing, behavior, app, location, and other datasets\u00a0<\/span><a style=\"font-family: inherit;font-size: 1rem\" href=\"https:\/\/www.techdirt.com\/2022\/05\/04\/data-brokers-selling-location-data-of-americans-who-visit-abortion-clinics\/\">could be easily purchased<\/a><span style=\"font-family: inherit;font-size: 1rem\"> and abused by authoritarian state governments and vigilantes (to potentially deadly and life-destroying effect) \u2014 30-plus years of activist warnings are coming home to roost, and the need for reform isn\u2019t going to be quite so easy to flippantly dismiss (not that these same folks won\u2019t still try).<\/span><\/p>\n<p>A lot of companies that made untold fortunes on the back of minimal accountability will soon face a brand new reality. The smarter ones are already getting ahead of a privacy debate paradigm shift that\u2019s going to be fed repeated accelerant in the form of scandals that will make the\u00a0<a href=\"https:\/\/www.techdirt.com\/2020\/05\/22\/banks-get-payout-equifax-hack-while-consumers-still-wait-compensation\/\">Equifax<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.techdirt.com\/2020\/03\/04\/t-mobile-cares-so-much-about-consumer-privacy-fighting-fccs-flimsy-fine-location-data-sharing\/\">T-Mobile location data scandals<\/a>\u00a0look like a beach-side picnic.<\/p>\n<p>After initially being silent, Google last week penned a\u00a0<a href=\"https:\/\/blog.google\/technology\/safety-security\/protecting-peoples-privacy-on-health-topics\/\">blog post<\/a>\u00a0announcing it would be deleting any user location data for those that have been near abortion clinics. It\u2019s a welcome start for a tech sector that couldn\u2019t be bothered to even issue rote promises immediately post-<em>Roe<\/em>:<\/p>\n<blockquote class=\"wp-block-quote\"><p><em>Today, we\u2019re announcing that if our systems identify that someone has visited one of these places, we will delete these entries from Location History soon after they visit. This change will take effect in the coming weeks.<\/em><\/p><\/blockquote>\n<p>There\u2019s not much detail on how this will work, and Google executives weren\u2019t willing to chat about the changes with the press. Will the deleted gaps create entirely new red flags for law enforcement? What about incognito user searches? What about other sensitive data collected by Android OS and Google hardware?<\/p>\n<p>Google did make it clear that having better, more ethical privacy standards and enforcement isn\u2019t something it can do on its own, however powerful it may be:<\/p>\n<blockquote class=\"wp-block-quote\"><p><em>Given that these issues apply to healthcare providers, telecommunications companies, banks, tech platforms, and many more, we know privacy protections cannot be solely up to individual companies or states acting individually. That\u2019s why we\u2019ve long advocated for a\u00a0<a href=\"https:\/\/blog.google\/outreach-initiatives\/public-policy\/the-urgent-necessity-of-enacting-a-national-privacy-law\/\">comprehensive and nationwide U.S. privacy law<\/a>\u00a0that guarantees protections for everyone, and we\u2019re pleased to see recent progress in Congress.<\/em><\/p><\/blockquote>\n<p>To be clear, large companies like Facebook and Google do want a federal privacy law. But they want a federal privacy law their lawyers help write.<\/p>\n<p>Google was also just busted for providing access to all manner of sensitive user data to\u00a0<a href=\"https:\/\/www.propublica.org\/article\/google-russia-rutarget-sberbank-sanctions-ukraine\">a sanctioned Russian adtech company owned by the country\u2019s biggest bank<\/a>, so again, there\u2019s often a sizeable gap between words and actions. And that gap is going to be relentlessly exposed post Roe by authoritarians that are going to push their decade-plus Supreme Court advantage as far as they possibly can.<\/p>\n<p>To be clear, this isn\u2019t an easy issue to solve. There\u2019s no switch to flip. Companies repeatedly make it clear they\u2019re not even fully in tune with the scope of their own data collection. Many activists, in turn, were quick to argue that if Google really wants to help, it could just collect less data overall:<\/p>\n<div class=\"responsive-embed\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">It&#39;s mindblowing the degree to which &quot;just collect a little less data&quot; is seen as so far beyond the realm of possibility inside Big Tech that they come up something that literally involves building some kind of massive internal database and surveillance apparatus to delete data<\/p>\n<p>&mdash; Evan Greer is on Mastodon and Bluesky (@evan_greer) <a href=\"https:\/\/twitter.com\/evan_greer\/status\/1543207836775235584?ref_src=twsrc%5Etfw\">July 2, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p>The Washington Post\u00a0<a href=\"https:\/\/www.washingtonpost.com\/technology\/2022\/07\/01\/google-privacy-abortion\/\">sang a similar tune<\/a>. But in a country with no federal privacy law, regulators that\u00a0<a href=\"https:\/\/www.marketwatch.com\/story\/congresswoman-shocking-that-ftc-has-only-8-of-the-staff-the-uk-does-devoted-to-privacy-data-security-2019-05-08\">lack the funding, authority, or manpower to actually police privacy<\/a>, a Congress that\u2019s completely gridlocked due to multi-sector corruption, and a high court making it extremely clear that already dwindling privacy and corporate accountability are on the chopping block, that just doesn\u2019t seem likely anytime soon.<\/p>\n<p>Most of the policymaking coming out of Congress in relation to \u201cbig tech\u201d (from Google to\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/06\/30\/fccs-carr-once-again-heads-to-the-fainting-couch-over-tiktok\/\">TikTok<\/a>) is generally just\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/05\/24\/stop-letting-the-trump-gop-pretend-it-cares-about-big-corporations\/\">performative noise<\/a>\u00a0designed to agitate the base or protect\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/05\/24\/stop-letting-the-trump-gop-pretend-it-cares-about-big-corporations\/\">online political propaganda<\/a>. There\u2019s no real incentive to truly get a competent privacy law or\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/05\/24\/stop-letting-the-trump-gop-pretend-it-cares-about-big-corporations\/\">real<\/a>\u00a0antitrust reform done anytime soon, and the Supreme Court seems intent on\u00a0<a href=\"https:\/\/www.forbes.com\/sites\/joshuacohen\/2022\/07\/05\/supreme-court-decision-on-epa-could-have-implications-for-other-regulatory-agencies-like-fda\/?sh=6f11b4e640d2\">dismantling the entire regulatory state<\/a>\u00a0as Congress dithers.<\/p>\n<p>Given government failure and the broad privacy dysfunction across telecom, adtech, apps, hardware, and media, consumers don\u2019t have a whole lot of autonomy on privacy. That leaves the onus on corporations to do better. And corporations only act on privacy when there\u2019s a scandal so obvious and grotesque they have no choice.
