At his deposition in the Texas case, Musk&#8217;s attorney, Quinn Emanuel&#8217;s Alex Spiro, repeatedly belittled the case and launched a string of speaking objections <a href=\"https:\/\/abovethelaw.com\/2024\/04\/is-elon-musk-about-to-get-quinn-emanuel-sanctioned\/\" target=\"_blank\" rel=\"noopener\">prompting a motion for sanctions<\/a>. The plaintiff also noted that Spiro hadn&#8217;t even been admitted <em>pro hac vice<\/em>, a move that&#8217;s mostly a formality, but that the plaintiff claimed spoke to Spiro messing up a number of local rules. In response, Quinn Emanuel cross-moved for sanctions and proposed <a href=\"https:\/\/abovethelaw.com\/2024\/04\/quinn-emanuel-proposes-using-time-travel-to-avoid-sanctions-motion\/\" target=\"_blank\" rel=\"noopener\">using time travel to retroactively admit Spiro to cure an issue with the pleadings<\/a>.<\/p>\n<p>The sanctions motion always represented a moon shot for the plaintiff, but, as we noted at the time, &#8220;using a deposition to denigrate the plaintiff\u2019s case and the attorneys involved is a breach of professional decorum regardless of the specific Texas rules.&#8221; Musk&#8217;s interest in <a href=\"https:\/\/abovethelaw.com\/2022\/05\/elon-musk-takes-time-out-from-failing-to-buy-twitter-to-fail-to-build-his-own-law-firm\/\" target=\"_blank\" rel=\"noopener\">&#8220;hardcore&#8221;<\/a> lawyering ended up dragging the whole case into petty motion practice and left an embarrassing video deposition.<\/p>\n<p>The judge seemed uninterested in anyone&#8217;s complaints, denying the motion for sanctions and the cross-motion for sanctions, granting all the pro hac motions, and overruling all of Musk&#8217;s objections while also denying the motion to dismiss.<\/p>\n<p>Will this bring down the temperature in the case&#8230; or will the hardcore come out again?<\/p>\n<p><strong>Earlier<\/strong>: <a href=\"https:\/\/abovethelaw.com\/2024\/04\/is-elon-musk-about-to-get-quinn-emanuel-sanctioned\/\" target=\"_blank\" rel=\"noopener\">Is Elon Musk About To Get Quinn Emanuel Sanctioned?<\/a><br \/>\n<a href=\"https:\/\/abovethelaw.com\/2024\/04\/quinn-emanuel-proposes-using-time-travel-to-avoid-sanctions-motion\/\" target=\"_blank\" rel=\"noopener\">Quinn Emanuel Proposes Using Time Travel To Avoid Sanctions Motion In Elon Musk Case<\/a><\/p>\n<hr \/>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-443318\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2016\/11\/Headshot-300x200.jpg\" alt=\"Headshot\" width=\"189\" height=\"126\" \/><strong><em><a href=\"http:\/\/abovethelaw.com\/author\/joe-patrice\/\" target=\"_blank\" rel=\"noopener\">Joe Patrice<\/a>\u00a0is a senior editor at Above the Law and co-host of <a href=\"http:\/\/legaltalknetwork.com\/podcasts\/thinking-like-a-lawyer\/\" target=\"_blank\" rel=\"noopener\">Thinking Like A Lawyer<\/a>.
