While a lot of this money will be going to the usual entrenched monopoly incumbents, a lot of it is\u00a0<strong>also<\/strong>\u00a0going to a growing list of popular\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/10\/02\/new-map-shows-community-broadband-networks-are-exploding-in-u-s\/\">cooperatives, municipalities, and city-owned utilities<\/a>\u00a0to expand affordable fiber.<\/p>\n<p>This\u00a0<a href=\"https:\/\/broadbandusa.ntia.doc.gov\/funding-programs\/broadband-equity-access-and-deployment-bead-program\">Broadband Equity Access and Deployment<\/a>\u00a0(BEAD) program is going to help bring a lot of competition and new fiber into numerous markets. So, as per obstructionist party tradition, Republicans are trying to kill or undermine it at every possibility.<\/p>\n<p>Republicans voted against the program, but then immediately turned around and\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/04\/03\/republicans-keep-taking-credit-for-local-broadband-projects-funded-by-federal-bills-they-voted-against\/\">took credit for the local improvements among their constituents<\/a>. They worked tirelessly to try and keep this money from\u00a0<a href=\"https:\/\/www.techdirt.com\/2021\/12\/29\/house-republicans-dont-want-infrastructure-money-going-toward-broadband-competition\/\">driving competition into Comcast and AT&amp;T markets<\/a>. They\u2019ve also launched show hearings after learning that the BEAD program is (gasp)\u00a0<em>trying to make sure this new broadband\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/09\/11\/gop-holds-show-hearing-to-complain-about-providing-affordable-broadband-to-poor-people\/\">is affordable to poor people<\/a><\/em>.<\/p>\n<p>Then there\u2019s Trump FCC pick Brendan Carr. Carr, you\u2019ll recall, spends all of his time\u00a0<a href=\"https:\/\/www.techdirt.com\/2022\/11\/02\/fcc-commissioner-brendan-carr-still-doesnt-understand-that-banning-tiktok-doesnt-fix-the-actual-problem\/\">whining about TikTok<\/a>\u00a0(a sector he doesn\u2019t regulate), but none of it on helping telecom consumers (a sector he actually regulates). And when he can focus on telecom, it\u2019s generally either to lobotomize corporate oversight, or do some favor for unpopular companies like Comcast and AT&amp;T.<\/p>\n<p>Like this new missive in\u00a0<a href=\"https:\/\/www.wsj.com\/opinion\/kamala-harris-rural-broadband-flop-her-project-is-stuck-in-slow-lane-regulation-2b84d0c2\">the Wall Street Journal<\/a>\u00a0(paywall) that tries to claim the BEAD program is a \u201cflop\u201d because it has taken some time to implement it:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cKamala Harris\u00a0lamented recently that \u201cin America, it takes too long and it costs too much to build.\u201d She\u2019s right. But she failed to mention that those costly delays are a feature, not a bug, of her progressive policies.\u201d<\/em><\/p><\/blockquote>\n<p>What Carr\u00a0<strong>doesn\u2019t\u00a0<\/strong>say is that a primary reason it has taken three years to get this component of the infrastructure bill off the ground\u00a0<em>was a direct result of Carr\u2019s own incompetence<\/em>. The Trump and Ajit Pai FCC (of which Carr was a key member)\u00a0<a href=\"https:\/\/www.techdirt.com\/2023\/06\/28\/the-trump-fcc-wasted-millions-in-broadband-subsidies-in-a-giant-mess-government-is-still-trying-to-clean-up\/\">completely mismanaged the FCC\u2019s $20.4 billion Rural Digital Opportunity Fund (RDOF)<\/a>, resulting in billions of dollars in fraud and various delays.<\/p>\n<p>The Pai FCC\u2019s mismanagement of RDOF was\u00a0<strong>so<\/strong>\u00a0severe, when it came time for the Biden administration to put an agency in charge of the BEAD program,\u00a0<strong>it selected the NTIA instead of the FCC<\/strong>. That\u2019s directly on Carr; but he just (whoops) doesn\u2019t mention that bit.<\/p>\n<p>Progress has been slow because the NTIA has been trying to do all of the stuff the FCC failed to do, like\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/06\/17\/u-s-broadband-maps-suck-slightly-less-but-still-let-isps-comically-over-state-coverage\/\">properly map broadband access<\/a>\u00a0to ensure the money is spent properly. And do a better job screening applicants to make sure they can actually deliver the broadband networks they promise.<\/p>\n<p>The Carr and Pai FCC didn\u2019t bother with this last bit, resulting in a long line of RDOF applicants (including Musk\u2019s Starlink) getting billions of dollars they didn\u2019t deserve, for projects they couldn\u2019t build. That resulted in a ton of defaulting bidders, and it has taken years for the Biden FCC to\u00a0<a href=\"https:\/\/www.fcc.gov\/document\/fcc-proposes-over-8m-fines-against-22-rdof-applicants-defaults\">clean up the Trump FCC\u2019s mess<\/a>. Worse, some of the communities stuck in default over RDOF bids now\u00a0<a href=\"https:\/\/communitynets.org\/content\/fcc-rejects-broader-relief-growing-list-rdof-defaulters\">can\u2019t qualify for BEAD funds<\/a>, boxing them out of a generational broadband funding opportunity due to Trump FCC incompetence.<\/p>\n<p>Starlink in particular was poised to receive nearly a billion dollars from Trump to deliver expensive, satellite access to\u00a0<a href=\"https:\/\/www.freepress.net\/blog\/space-x-broadband-coming-empty-traffic-island-near-you\">a handful of airport parking lots and traffic medians<\/a>. The Biden FCC (correctly) retracted that award, stating it wasn\u2019t clear that the\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/10\/01\/capacity-crunch-causes-musks-starlink-to-sock-users-with-100-congestion-charge\/#:~:text=Facing%20these%20growing%20congestion%20issues,%2C%E2%80%9D%20a%20Starlink%20FAQ%20says.\">increasingly congested Starlink network<\/a>\u00a0could actually deliver consistently promised speeds. They also said Starlink access was expensive, instead redirecting these funds toward more \u201cfuture proof\u201d and affordable local fiber and wireless access. I\u2019ve\u00a0<a href=\"https:\/\/www.techdirt.com\/2023\/03\/29\/biden-fcc-makes-some-empty-noise-about-cracking-down-on-bullshit-cable-broadband-fees\/\">criticized the Biden FCC plenty<\/a>; but on this particular point they were absolutely correct.<\/p>\n<p>Still, Musk and Republicans have been throwing a noisy hissy fit ever since. Carr continues it in the pages of the Journal, falsely claiming the FCC engaged in \u201cregulatory warfare\u201d because it didn\u2019t give a billionaire a billion dollars for slow, expensive broadband access:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cAs I noted in my dissent at the time, the FCC\u2019s revocation couldn\u2019t be explained by any objective application of the facts, the law or sound policy. In my view, it amounted to nothing more than regulatory lawfare against one of the left\u2019s top targets: Musk. Rural communities stuck on the wrong side of the digital divide are paying the price.\u201d<\/em><\/p><\/blockquote>\n<p>That the GOP cares about the \u201cdigital divide\u201d is a fiction. That the party cares about funding broadband access to rural communities is a fiction. That the party cares about government being efficient with taxpayer money is a fiction.<\/p>\n<p>Republicans have fought against improving the quality and affordability of broadband access for the better part of thirty years, both by undermining regional competition, and by dismantling what\u2019s left of corporate oversight and consumer protection. It routinely goes out of its way to protect entrenched monopolies like AT&amp;T and Comcast from competition and accountability\u00a0<em>at every turn<\/em>.<\/p>\n<p>Carr\u2019s goal is to paint the BEAD infrastructure bill program as a boondoggle, knowing full well money from the popular program will begin to flow to local constituents\u00a0<strong>after<\/strong>\u00a0the election season. As with all government programs BEAD certainly\u00a0<em>will have problems<\/em>, but in this instance the NTIA is\u00a0<em>actually trying to do things right<\/em>. That takes time.<\/p>\n<p>BEAD\u00a0<strong>will<\/strong>\u00a0have a transformative impact on many rural, disconnected markets. I know this because part of my work involves\u00a0<em>talking to a different red or blue municipality every single week<\/em>, which all tell me they\u2019re poised for some amazing improvements. And Carr certainly doesn\u2019t want locals understanding that Republicans have tried to dismantle a popular program\u00a0<em>that\u2019s actually benefiting them<\/em>.<\/p>\n<p>Should Trump win the White House, you can be fairly certain Carr will be the next agency boss. He\u2019s outlined what he\u2019ll do in his Project 2025 chapter on how the FCC should be run, which largely involves repurposing the agency to\u00a0<a href=\"https:\/\/www.techdirt.com\/2024\/07\/23\/fccs-carr-wrote-a-project-2025-chapter-on-ruining-the-fcc-and-taxing-tech-giants-which-may-have-violated-the-hatch-act\/\">harass, tax, and nanny tech companies<\/a>\u00a0that don\u2019t kiss the authoritarian ring, and harass media companies that speak critically of King Trump.<\/p>\n<p>You can be absolutely sure Carr will redirect as much BEAD money as possible to Elon Musk and monopolies like AT&amp;T, and dismantle the most useful parts of BEAD (like the efforts to fund popular community-owned broadband networks).
