On Monday, the chief judge of the U.S. Court of Appeals for the Ninth Circuit <a href=\"https:\/\/abovethelaw.com\/2011\/04\/chief-judge-kozinski-to-the-winklevii-please-go-away-now\/\">benchslapped<\/a> a pair of wealthy, persistently annoying and mildly famous identical twins.<\/p>\n<p>The same day, he gave a lecture at San Francisco\u2019s Golden Gate University School of Law, where he declared the Internet has killed the First Amendment, or at least made it an anachronism. Heavy stuff.<\/p>\n<p>More on what the judge said about the web&#8217;s effect on unsuppressable free speech, journalism and scumbag bloggers, after the jump.<\/p>\n<p><!--more--><\/p>\n<p>According to the <a href=\"http:\/\/legalpad.typepad.com\/my_weblog\/2011\/04\/alex-kozinski-came-to-golden-gate-university-school-of-law-on-monday-to-praise-the-first-amendment-and-to-bury-it-appear.html\">Legal Pad<\/a> blog:<\/p>\n<blockquote><p>[Kozinski] argued that technology has rendered the First Amendment obsolete. As incidents ranging from Wikileaks disclosures to Barbra Streisand&#8217;s house have demonstrated, it&#8217;s no longer possible for the government or individuals to suppress speech in an age of distributed self-publishing via blogs and social networks.<\/p>\n<p>&#8220;How do you sue a blogger who may be anonymous, or may be posting from Uzbekistan?&#8221; Kozinski asked. &#8220;And assuming you somehow get service of process and prove that he acted with malice, so what? How do you collect a judgment against a guy whose principal assets are an iMac and a genuine autographed poster of ZZ Top?&#8221;<\/p><\/blockquote>\n<p>In libel cases, the risk that publicity over a lawsuit will be as embarrassing as the original malicious statement is not new. But Judge Kozinski said the problem is no longer government censorship. It\u2019s the general inability to suppress speech at all, even when it might be appropriate.<\/p>\n<p>\u201cUber-free\u201d speech doesn\u2019t only facilitate social change, as in Iran two summers ago. It also gives crazies and &#8212; perhaps more significantly &#8212; big jerks enough visibility and influence to damage the ability of more \u201ctrustworthy voices\u201d [FN1] to function and distribute content. In this <a href=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?hubtype=&amp;id=1202489747329&amp;Kozinski_and_the_First_Amendment\">video<\/a> from the presentation, he gives an example about a blogger&#8217;s allegations of your &#8220;loathsome illness.&#8221;<\/p>\n<blockquote><p>&#8220;When speech is not suppressable, the careful First Amendment balance is destroyed,&#8221; he said. &#8220;We now live in a world where the lowest common denominator &#8212; the judgment of the most irresponsible, callous, insensitive or malicious speaker &#8212; governs what we see and read.\u201d<\/p><\/blockquote>\n<p>Kozinski told attendees, \u201c<a href=\"http:\/\/cityroom.blogs.nytimes.com\/2011\/04\/05\/the-legal-side-of-bob-dylan\/?scp=6&amp;sq=bob%20dylan&amp;st=cse\">It ain\u2019t your lawyers, babe,<\/a>\u201d who will eventually find a way to separate the wheat from the chaff. He explained what a lot of people already know: the courts will always lag behind technology.<\/p>\n<p>From the <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1202489697023&amp;9th_Circuits_Kozinski_Internet_Guilty_of_Killing_1st_Amendment&amp;slreturn=1&amp;hbxlogin=1\">Law Technology News<\/a>:<\/p>\n<blockquote><p>&#8220;I have good faith in the ingenuity of people to solve problems &#8212; but I am not sure how it will be done. Don&#8217;t count on the courts. We are good for many things and we try to keep up with technology and understand it, but things move so quickly. Technology can change in a year or two. In a sense, we are helpless to provide any help.&#8221;<\/p><\/blockquote>\n<p><a href=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2011\/04\/laptop-pink-girl-woman-Abovethelaw-Above-the-Law-blog.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-67596\" title=\"laptop pink girl woman Abovethelaw Above the Law blog\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2011\/04\/laptop-pink-girl-woman-Abovethelaw-Above-the-Law-blog.jpg\" alt=\"\" width=\"176\" height=\"153\" \/><\/a>The whole thing kind of makes my brain hurt. Too much free speech? This is not what First Amendment advocates usually freak out about. Besides, you don\u2019t need to look hard to find examples of people\u2019s First Amendment rights still being restricted.<\/p>\n<p>I can\u2019t help hoping Kozinski\u2019s language is a bit strong, but then I think about all the humiliating things that end up online, sometimes end up in court, and stay online forever. (For example: <a href=\"http:\/\/www.youtube.com\/watch?v=HPPj6viIBmU&amp;feature=related\">Star Wars Kid<\/a>; <a href=\"https:\/\/abovethelaw.com\/2011\/03\/jack-king-husband-of-judge-lori-douglas-pleads-guilty\/\">naked pictures<\/a> of judges.)<\/p>\n<p>So, are Judge Kozinski\u2019s concerns exaggerated?
