{"id":8834,"date":"2019-05-09T16:30:33","date_gmt":"2019-05-09T20:30:33","guid":{"rendered":"https:\/\/abovethelaw.com\/?p=547010"},"modified":"2019-05-09T16:30:33","modified_gmt":"2019-05-09T20:30:33","slug":"california-bar-exploring-opportunities-to-deploy-ai","status":"publish","type":"post","link":"https:\/\/abovethelaw.com\/legal-innovation-center\/2019\/05\/09\/california-bar-exploring-opportunities-to-deploy-ai\/","title":{"rendered":"California Bar Exploring Opportunities To Deploy AI"},"content":{"rendered":"<p><span class=\"s3\"><span class=\"bumpedFont15\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-477960\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2017\/09\/200143_96965466-300x250.jpeg\" alt=\"\" width=\"300\" height=\"250\" \/>The State Bar of California has started wading into the artificial intelligence waters.<\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">The agency is exploring ways AI could help bolster the efficiency of its attorney discipline system and assist with administering the bar exam.<\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">The bar recently entered into a contract with <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">MITRE Corporation to help it develop and evaluate algorithmic processes for identifying whether a<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">n <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">attorney misconduct<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> complaint<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> could be closed without investigation.<\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">State Bar Executive Director Leah T. Wilson said if an AI tool can be crafted to help the bar more speedily review whether to close or investigate complaints, it would reduce the administrative burden on staff. That <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">in turn<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> would allow the bar to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">shift its &#8220;human resources to other parts of the case processing continuum,\u201d <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Wilson<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> said.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Freeing up staff to assist with serious allegations of lawyer misconduct could be beneficial in light of the state auditor\u2019s recent <\/span><\/span><a href=\"https:\/\/abovethelaw.com\/2019\/05\/state-bar-gets-warmer-reception-from-california-auditor\/\"><span class=\"s5\"><span class=\"bumpedFont15\">recommendation<\/span><\/span><\/a><span class=\"s4\"><span class=\"bumpedFont15\"> that the State Bar not hire as many new employees for its discipline unit as desired.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Wilson said an AI tool could also <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">assist in<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> ensur<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ing<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> a level of consistency and standardization in the bar\u2019s review of the roughly 16,000 attorney misconduct complaints it receives annually<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">The technology could be especially helpful amid a nearly 60 percent increase in complaints <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">made to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">the bar in recent months, a bump that has come amid the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">agency <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">starting to accept online complaints. \u00a0<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">It was the transition <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">last fall <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">permitting<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> online complaints that allowed the bar to even contemplate an AI tool for reviewing such filings, according to Wilson.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">She stressed that the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">MITRE <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">project is in the early stages<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> and the bar will closely examine the effectiveness of the tool <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">developed<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">\u201cIf it<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">\u2019s<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> not reliable to a <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">very high <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">degree of statistical significance, we could<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">n\u2019t <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">implement it,\u201d Wilson said. <\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">The bar\u2019s $90,000 contract with MITRE<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, which was signed last month, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">calls for the company to complete its work on the project by mid-October.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Meanwhile, the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">State Bar<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> is planning to use AI to help it administer the First-Year Law Students&#8217; Examination, known as the \u201c<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">B<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">aby <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">B<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ar.\u201d Law students completing their first year of law study at an unaccredited law school or through the Law Office Study Program<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> are\u00a0<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">among <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">those who<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> must take the test.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">At <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">tw<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">o<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> of the sites where the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">B<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">aby <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">B<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">ar will be given next month, the bar will be piloting the use of AI proctor<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> for the essay portion of the exam <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">that is <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">taken on <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">computers<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, Wilson said. <\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Live proctors<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> will be there as well to ensure things go smoothly<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> and <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">to <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">respond if the AI software alerts them to any <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">patterns of eye movement or gesture<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> out of the norm for test takers<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">\u201cIf all goes well, it is our intention to deploy AI proctoring for the July bar exam,\u201d Wilson said.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">The bar began exploring AI proctoring because it struggled last year to attract enough proctors to administer the exams it gives to prospective lawyers.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Wilson said there will <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">still <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">need to be <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">some <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">human proctors present at future exams for security purposes<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> and to help with any issues that arise<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, according to Wilson. But she said a successful pilot of AI proctoring would reduce the overall need for human proctors moving forward.\u00a0<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">O<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">n both the bar exam and attorney discipline fronts, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Wilson said the bar<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> is seeking to strike the right balance between being forward-leaning while protecting against the risks that arise with the deployment of new technologies.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">\u201c<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">I think it is <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">responsibility of good government everywhere to figure out how we can take advantage of technology to improve the services that we provide to the public,\u201d she said.<\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">Separate from the initiatives <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">mentioned <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">above, a <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">bar <\/span><\/span><a href=\"https:\/\/abovethelaw.com\/2019\/04\/legal-tech-tools-can-be-vastly-improved-california-bar-task-force-told\/\"><span class=\"s6\"><span class=\"bumpedFont15\">task force<\/span><\/span><\/a><span class=\"s3\"><span class=\"bumpedFont15\"> is actively working to identify regulatory changes that would provide members of the public with greater access to legal services through technology, such as AI.<\/span><\/span> <span class=\"s3\"><span class=\"bumpedFont15\">The <\/span><\/span><span class=\"s7\"><span class=\"bumpedFont15\">next meeting of the Task Force on Access Through Innovation of Legal Services is Monday, May 13.<\/span><\/span><\/p>\n<hr \/>\n<p><em><strong><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-thumbnail wp-image-536867\" src=\"https:\/\/abovethelaw.com\/wp-content\/uploads\/sites\/4\/2019\/04\/Lyle-Moran-ATL-e1554338264129-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/>Lyle Moran is a freelance writer in San Diego who handles both journalism and content writing projects.
