A law school friend told me about a deposition he defended in Waco, Texas, where the temperature reached 105 degrees. At the time, my friend Geoff was an associate at a stuffy BigLaw firm, and there was never any doubt that he was required to wear a suit. And especially because the deposition was videotaped, the witness did, too.
Plaintiffs’ counsel was the owner of a smallish firm in Florida and he showed up wearing shorts, sandals and a short-sleeved polo shirt.
When they arrived at the deposition location, Geoff and his witness were dismayed to learn that the air conditioning wasn’t working. As the day progressed, the conference room grew increasingly warm. By late morning, the witness was restless and hot and kept firing glances across the room to the dormant air conditioner. The video was priceless; every answer was punctuated by the witness sweating and mopping his forehead. Geoff told me later that he thought his witness looked like he was lying even when he wasn’t.

As we mentioned in Morning Docket, the American Lawyer recently released its highly influential, closely watched Am Law 100 law firm rankings. They say that “slow and steady wins the race,” and with regard to economic recovery, Biglaw firms seem to have taken that up as their new motto.
Yes, partners are still living as large as they ever were, but their success now comes in the form of single-digit returns with regard to key financial metrics. The divide between the “haves and the have-nots” in the world of major law firms has grown to epic proportions, and some Am Law 100 staples have fallen out of the top hundred firms altogether. Welcome to the new normal.

As both trial lawyers and journalists well know, there are (easily more than) two sides to every story. The same underlying events can give rise to completely different narratives, depending on whom you talk to.
Yesterday we wrote about Weil Gotshal’s reaction to losing two litigation partners to Quinn Emanuel in D.C. Since our story was published, we’ve heard from multiple sources who vigorously dispute our prior tipsters’ version of events….
Two litigation partners in the Washington office of Weil Gotshal, Michael Lyle and Eric Lyttle, have left Weil to join the D.C. office of Quinn Emanuel. Lyle, a successful trial lawyer who also worked in the White House during the Clinton Administration, was particularly prominent at Weil Gotshal: he served as managing partner of the D.C. office and was a member of the firm’s management committee.
Quinn Emanuel has been on a lateral hiring tear, so it’s not exactly shocking when they lure stars away from other firms. And QE’s Washington office has been particularly active on the hiring front. Just last month, for example, they hired a longtime federal prosecutor, Sam Sheldon, deputy chief of the Criminal Division’s Fraud Section, out of the Justice Department.
So here’s what is especially interesting about the Lyle and Lyttle departures: how Weil reacted to the news. Let’s just say Weil didn’t take it sitting down….
I’ve previously mentioned how much I enjoy The Hunt, Joyce Cohen’s weekly column in the New York Times in which she describes the housing search of someone brave enough to take on the NYC real estate market. Prior installments of the column have featured lawyers and even law students.
Last week’s installment featured a lawyer at Quinn Emanuel, who went house hunting with his wife, who works at a test-preparation company. The home they wound up getting would probably be viewed as bike storage by John Quinn, but it’s plenty nice by the standards of mere mortals.
How much did they pay, and how much space did they get? Would you be impressed if I told you they got 1,500 square feet for less than $750,000?
Today, the National Law Journal released its list of the 100 most influential lawyers in America. The NLJ releases a similar list once every few years, and each time, the nation’s top lawyers — some from Biglaw, some from legal academia, some from the in-house world, and some from the trial and appellate bars — celebrate their success in creating real change in the industry. That said, the people named to this list are relatively well-known to the general Above the Law readership, but they won’t exactly be household names to laypeople.
Which legal eagles soared into the NLJ’s list this time around? Well, the NLJ selected their influential lawyers based on their political clout, legal results, media penetration, business credibility, and thought leadership. We’ve whittled the impressive list of 100 down to our own top 10.
I think everybody who has ever sat in a windowless conference room while staring at a screen and clicking through millions of documents has thought to themselves: “I wish I were dead.” “Somebody, please help me, it hurts.” “Zihuatanejo.” “I am not doing legal work.”
Whether you find yourself contracting after three years of law school or you were fired from a real legal job and are now contracting in lieu of moving back home with your parents, you don’t actually need a law degree to know that trained chimpanzees could be doing contract attorney work. In fact, the only reason they don’t use trained chimpanzees is that it’s much, much cheaper to train human beings to do it. And after a while, the chimps might revolt and kill their document room overseer while the humans will sit there in docile and vain hopes that one day they might get a real lawyer job.
Which brings us to the subject of today’s lawsuit challenging the Biglaw system of hiring contract attorneys to do menial, low-level, thoughtless work, and then not paying them overtime. Attorney Willian Henig has sued Quinn Emanuel alleging that contract attorneys should not be exempt from the Fair Labor Standards Act rules about overtime pay.
We’ve seen suits like this before, but this one is coming at one of the biggest and most well-known firms in all of Biglaw….

Deal flow has clearly picked recently up for most US associates, counsels and partners in Hong Kong/China and Singapore. We are on the phone with a lot of these folks on a daily basis, many of whom we have known for years. Further, the head of our Asia team, Evan Jowers, and Kinney’s founder and president, Robert Kinney, frequently meet in person with leading US partners in Asia to assess their needs and keep on top of the inside scoop at as many firms as possible. The need for legal recruiting help in Asia from experienced recruiters appears to be live and well. In March, Evan and Robert were in Beijing at such meetings, in April, Evan was in Hong Kong, and for half of June Evan will be in Shanghai and Hong Kong. Thus its pretty easy for us to tell when there has been an across-the-market pick up in capital markets and corporate work.
On an average day in Asia when Evan and Robert visit firms, they typically have 5 to 9 meetings a day, mostly with US partners in the market. The reason they have these meetings is not simply because Kinney makes a lot of US attorney placements in Asia and that a particular firm may have openings; instead these are just visits with friends. After years of working together as business partners, the folks at Kinney are actually these peoples’ friends. The firms Kinney work closely with in Asia (which is just about every law firm – call us if you want to know the one firm in the world we will never place anyone with again, ever, and why) look forward to the visits, or at least act like they do. After seven years in the market, many of the client partners are former associate candidates. Also, these US partners see Kinney as a very good source of market information as well, because they know how deep their contacts are in the market and how frequently they are speaking to counterparts at peer firms.
