What Does The Future Hold For Litigation Finance? The 2019 Survey Report

Will the industry's growth trajectory continue?

Litigation finance is booming. In fact, more than 40 percent of respondents to our recent survey have firsthand experience with the practice, and 4 out of 5 in that experienced group would recommend it to peers and colleagues. No longer the province of a limited number of innovators and early adopters, litigation finance has undergone momentous growth and is now firmly established as a means of not only funding under-resourced plaintiffs, but for any plaintiff, including large corporates who want to hedge risk, utilize off-balance-sheet financing, or raise capital for other expenses. But what does the future of litigation finance hold?

Our survey, conducted together with our friends at Lake Whillans, aimed at capturing the perspective of litigators and in-house counsel regarding the current state and future direction of the litigation finance industry. Nearly 400 practitioners shared their insights, and our findings reveal some surprising and thought-provoking insights into such forward-looking questions as:

  • Will litigation finance’s growth trajectory continue?
  • Will portfolio financing be the biggest driver of growth for litigation finance?
  • Which is the bigger threat to the future of the industry — market saturation or burdensome disclosure requirements?
  • And much more…
