Judge Wood Beats Dog
A rolled up newspaper of a benchslap.

— Chief Judge Diane Wood, beating up — rhetorically — on a poor K-9 dog whose shocking inaccuracy (Lex signals that drugs are present 93 percent of the time) renders him a walking pretextual search generator for his handlers. The court ultimately upheld conviction below, but couldn’t help but roll up a newspaper and benchslap Lex and his handlers. The Seventh Circuit opinion also pointed out that the police — unbelievably — gave Lex “rewards” every time he alerted them to drugs, whether or not he turned out to be correct.
Bad dog.
