“Wait, was that a flash grenade?”
“Oh, now there’s a picture!”
“They arrested journalists… just for being in a McDonald’s?”
“Now the arrested reporters are back online!”

Last night, many of us fixated on our Twitter feeds to follow, in real time, every breaking development in Ferguson, Missouri. The hashtag acted as a latter day, crowdsourced ticker tape keeping those miles away from the town — clear to Gaza — abreast as the peaceful protests brought on a symbolically striking military-style occupation, complete with the use of gas and rubber bullets and the arrest of journalists for performing their constitutionally protected jobs.

That’s what Twitter did that was awesome. Unfortunately, last night also put on display everything awful about Twitter. Everything that people mistake it to be when they set up a handle and broadcast their message to the world in 140 character segments. Others have tackled what Ferguson means in the grand scheme of criminal law and what lawyers should do in response to Ferguson. But there are also lessons to be learned from “#Ferguson” — the cyber place that conveyed the events of Ferguson — and the opinions of casual observers — to the world.

Lessons that all technologically connected lawyers, and frankly everyone, can use….

Every single thing women in the legal profession do is scrutinized, from the way they dress, to how they speak, and even the length of their hair. They say that women who are lawyers can have it all, but when we live in a world where we’re put up against such odds, it seems like an improbable, if not impossible, feat.

That’s why attorneys across the country are talking about a recent law school graduate who is trying to make her name in the legal community. This woman has a foot in two worlds — she’s a lawyer, but she’s also a bikini model, and she’s very upset that people may not take her seriously because of all of the skin she shows online.

Some are calling her an “HR nightmare,” but others are praising her for daring to dream. Who is she, and why should you care about her?

Yesterday over at Hercules and the Umpire, Judge Kopf noted an article from the Federal Judicial Center regarding social media use among jurors. Also in the article was a brief bit on social media use by attorneys during voir dire.

Most judges stated they did not know whether attorneys were using social media during voir dire, and most do not address the issue with attorneys before voir dire. Only 25 judges reported they knew attorneys had used social media in at least one of their trials, usually during voir dire. Attorneys may have used social media to look at prospective jurors’ Facebook pages, to run names through search engines, or to look at online profiles, blogs or websites. Of the 466 judges responding to this survey question, 120 do not allow attorneys to research prospective jurors online during voir dire.

Which caused Judge Kopf to ask: “So long as the use of social media by a lawyer in the courtroom picking a jury is discreet, why in the world would a federal judge interfere with a lawyer using social media to obtain information about jurors during the jury selection process? That doesn’t make any sense to me? ”

ExamSoft made many bar takers cry last night.

In case you’re not already well aware, last night the legal profession stood witness to the biggest bar exam disaster in history. Bar exam takers nationwide were absolutely enraged — as they rightfully should have been — because ExamSoft’s servers were overrun by thousands of aspiring lawyers trying to upload their essays before their state’s deadline came and went.

Instead of going about their business and exhibiting “forbearance with the situation” as requested by the bane of their collective existence, bar takers flocked to Twitter to shake their virtual fists in anger in tweets directed at ExamSoft.

As you can imagine, there were some very entertaining tweets being sent out. If you love schadenfreude and other people’s pain brings you pleasure, you’ll love this…

My first reaction when I heard of the Facebook mood study (PDF) was that it’s totally unethical and it’s going to set Facebook back a ways. I couldn’t figure out why Facebook couldn’t see it that way and wasn’t responding accordingly.

In a nutshell, the study, which was published in the Proceedings of the National Academy of Sciences and conducted by Facebook researcher Adam Kramer, Jeffrey Hancock of Cornell University, and Jamie Guillory of the University of California at San Francisco, revealed that Facebook had manipulated it’s Newsfeed in order to gauge how users’ moods and subsequent posts were affected.

After realizing that advertisers and marketers test our moods in response to color, sounds, pictures, and more each and every day — and that it’s been common practice for decades — I see Facebook as no better nor worse…

Having personally experienced the lows of depression and the positive energy that comes from blogging and social media, I have to believe the effective use of social media could prevent depression for many lawyers.

In a story outside of law, AP sportswriter John Marshall (@jmarshallap) reported Monday on the positive impact social media is having on a six-time Olympic gold medal winner, Amy Van Dyken (@amyvandyken), just a few weeks after she suffered a life-threatening spinal injury.
