Chief Justice Roberts Tries To Be Respectful, Fails

If you are among the many Americans — of whatever sexual orientation — who favor expanding same-sex marriage, by all means celebrate today’s decision. Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not celebrate the Constitution. It had nothing to do with it.

–Chief Justice John Roberts, in his dissent in Obergefell v. Hodges. He also said the “Court’s accumulation of power… comes at the expense of the people,” apparently ignoring the motivating purpose of the judicial branch as the vanguard against the tyranny of the majority. Perhaps he is just having a “senior moment.”
