D.C. Circuit Judge Talks Justice League In Recent Opinion

It's a bird! It's a plane! It's jurisprudence.

The same principles that prevent any individual caped crusader from using the courts to vindicate his or her views as to the proper enforcement of the laws should preclude the same gambit by a group of likeminded individuals. As for Batman or Wonder Woman, so too for the Justice League.

D.C. Circuit Judge Patricia Millett, in a rare dubitante opinion in PETA v. Dep’t of Agriculture. The quote, caught and posted on Twitter by the National Law Journal’s Zoe Tillman, is the second high-profile citation to comic books this year after Justice Kagan cited Spider-Man approvingly in June. But Judge Millett opted for characters from Marvel’s competitors because, of course, this is a D.C. case.
