Caption Contest Winner: Justice Never Sleeps -- Except During Oral Arguments

As is customary with our caption contests, we’ll now reveal the backstory behind the picture. This courtroom sketch was created by Arthur Lien on April 20, 2016, during oral arguments in Birchfield v. North Dakota. Justice Thomas wasn’t sleeping — it just looks like he was. According to Lien, who has been doing courtroom sketch work for about 40 years, Justice Thomas “often leans way back in his chair and looks at the ceiling.” In response to an email from the Huffington Post, Lien noted that Justice Thomas “does give the appearance of being disengaged at times, but then he’ll sit up and lean forward as if he’s about to ask a question, which of course he rarely does.”
