For more than a decade now, we have witnessed the seemingly inexorable growth of the commercial litigation finance market as means to finance claims, hedge risk, and fund operating expenses. For both corporations and law firms, the trend has been the same: ever-broadening acceptance of litigation finance as not just a viable option, but an attractive one. Late in 2018, together with our friends at Lake Whillans, we fielded a survey aimed at capturing the perspective of practicing litigators and in-house counsel regarding this increasingly relevant and established means of accessing capital. Nearly 400 respondents ultimately shared their insights, and our findings reveal a detailed and sometimes surprising portrait of the ongoing dynamics of the practice:
