A target letter is no joke.

When former president Donald Trump announced to the world he was the recipient of a target letter courtesy of special prosecutor Jack Smith, he almost gleefully said this “almost always means an Arrest and Indictment.” However, Trump hasn’t always demonstrated the most acute legal acumen (in addition to his wild stance on capitalization). So, the public might want to take this information with a grain of salt, but a Biglaw partner is here to back up Trump’s take.

Former U.S. attorney for the Southern District of New York and current Dechert partner David Kelley went on Ari Melber’s MSNBC show to discuss Smith’s investigation into the Jan. 6, 2021, attack on the U.S. Capitol and what getting a target letter means for Trump. Kelley did not pull his punches, revealing, “It means to you you’re done. It means you’re going to get indicted.” Now that Kelley works on the defense side of the white collar world, he knows that, “From the perspective of a defense lawyer, the last thing you ever want in the world is to get a target letter.”
