Court-Martial Begins for Bradley Manning; He Faces 22 Counts and Life in Prison
Bradley Manning, the American traitor or human rights champion depending on your perspective, was back in court yesterday. His court-martial officially began, and he now faces 22 serious charges that could carry a life sentence, if he is convicted. The 24-year-old Army intelligence analyst allegedly gave more than 700,000 classified documents to Julian Assange, the […] -

Is Peeing On Somebody A War Crime?
Is peeing on somebody's dead body a war crime? The video of those American Marines urinating on dead Afghan bodies is so disturbing that it somehow demands a legal response. Aside from whatever punishment the United States Marine Corps wants to impose on these guys, there isn't a whole lot the international community can do to punish them. Unless we want to call urinating on somebody a "war crime." But is punishing some jackasses worth diluting the term? - Sponsored

Should Suffolk Fire Michael Avery For His Anti-Military Comments?
Dear Suffolk University Law School Administrators: Your Michael Avery problem is not going away (and not just because he has tenure). Now, an adjunct law professor currently in Kabul has cut ties with Suffolk because of Avery, and Suffolk is now in the uncomfortable position of de facto supporting Avery's comments against a pissed-off military. What should the school do now? -

Suffolk Law Supports the Troops, and Free Speech, and the Constitution, and Everything Else!
On Friday, we told you about Michael Avery, a professor at Suffolk University Law School who objected to a school-wide solicitation for care packages for American servicemen fighting in Afghanistan. Both the dean of the law school and the president of the university are now weighing in and defending, well, everything.... -

Law Professor Objects to Solicitations to Help Our Troops in Afghanistan
On Wednesday, a law professor wrote a screed objecting to a solicitation to send care packages to troops deployed in Afghanistan. Let me say that again: the professor was pissed off that students were asked if they could send care packages to soldiers serving abroad. Yeah, happy Veterans Day.... -

Size Matters: Small Firm Travels Great Distances
This weekend I watched the three-part Moroccan adventure on Real Housewives of New York. Each moment was more awkward than the next as I watched the worst clichés about Americans acted out on screen. I could not imagine a more inappropriate set up other than if Bravo had sent a group of small-firm lawyers to […] -

I have not the slightest doubt that it was entirely appropriate for U.S. forces to [take out Osama bin Laden]…. I must say I was proud of the SEALs. — Justice John Paul Stevens, in remarks made yesterday at a dinner in Chicago. (Recall that Justice Stevens served in the Navy during World War II.) -

More Fun From Chief Judge Kozinski
There’s always something fun going on in the Ninth Circuit. Last week, the Court voted against rehearing en banc in United States v. Senate Repeals 'Don't Ask, Don't Tell' Law
Here’s a nice surprise on this otherwise quiet Saturday afternoon in late December. The vote to repeal the law was 65-31, with eight Republicans joining the Democrats. For additional discussion and analysis, see […] -

'Don't Ask, Don't Tell' Held Unconstitutional
This year has been a big one for LGBT rights litigation. There was Judge Vaughn Walker’s ruling in Perry v. Schwarzenegger, striking down Proposition 8’s ban on gay marriage in California. There were the Massachusetts decisions by Judge Joseph Tauro, holding unconstitutional section 3 of the Defense of Marriage Act (DOMA). And in a decision […]
