When I graduated from law school, I decided that I would take a job at a large law firm because it would maximize my chances of going in-house. I had no idea what either job would entail, but it seemed like a sensible plan. And, even without knowing what it would be like to be a litigation associate in Biglaw, I suspected it would be bad enough that an exit strategy would be necessary.
A few years later, I switched my exit strategy and went to a small firm. I decided that I could not wait for three to five more years to get the skills required to go in-house. So, I went to a small firm to get “hands on experience” and position myself for my new exit strategy: a federal government job. Then, hiring for federal jobs froze, and the few openings were impossible to get unless you had the exact experience required and could figure out your grade level. Consequently, I am currently reformulating my exit strategy. I am contemplating running for president or becoming a certified yoga instructor.
I have yet to meet a lawyer who did not plan or fantasize about his or her exit strategy from law firm associate, be it Biglaw or small. I blame it on the nightmare that is billing hours — even if the requirement might be less at some places. The most common exit strategies are (1) in-house and (2) fitness professional.
Is it possible, however, for a small-firm associate to go in-house, or is the small-firm associate required to follow my path and find a new exit strategy?

Back in 2009, some teen girls in Indiana had a sleepover that lived up to any teen boy’s fantasy version of one. After racy photos from the summer slumber party made their way to the principal’s office, two of the athletes in attendance were suspended from school sports for the year. That’s, like, totally unfair, said the ACLU, which helped the students sue the school, alleging violation of their First Amendment right to post slutty photos of themselves online.
The girls took photos of themselves “playing” with “phallic-shaped rainbow colored lollipops,” in the court’s words. It sounds like the oh-so-innocent unicorn horn lollipop to me. Though unicorns are usually associated with purity and virginity, these girls took the horn in a different direction, using it in photo shoots that simulated various sexual positions. I’ll leave the descriptions to the court, which wrote one of the racier opinions [pdf] I’ve ever come across (via Professor Eric Goldman’s Technology and Marketing Law Blog)….

Being a jock’s agent is a selfish business. Law is anything but a selfish business, and it has saved me emotionally and spiritually. I am learning something every day, and I just love the arena. In a courtroom or arbitration, people of different opinions can get along. They respect each other. That’s not always the case at the racetrack.

The winner of the July contest won in a landslide. Regular readers of Above the Law will not be surprised to learn that Elana Nightingale Dawson, a recent law school graduate who went into labor while attempting to pass the bar, won our lawyer of the month poll — even if she’s not yet a practicing attorney. That’s just how we roll around here.

Edwards Angell & Wildman Harrold: A match made in heaven?
What results from the coupling of an angel and a wild man? One might think: angel + wild man = air traffic nightmare.
In the law firm context, however, the result is quite different. Edwards Angell is merging with Wildman Harrold, to form Edwards Wildman Palmer. The merger will take effect on October 1 and “will bring together 650 lawyers across two legacy firms renowned for their deep experience, shared dedication to client service, and highly collaborative cultures,” according to the new firm’s website.

Two betas and an alpha
Do you ever get the feeling that the a$$holes in your office end up doing better than the decent folks? Yeah, you’re not wrong. A new study shows the people who score below average in “agreeableness” make more money than people who are nice.
The study’s authors offer a bunch of possible reasons for this. Agreeable men (the salary gap is bigger for men) might not conform to “masculine” norms. Disagreeable people might be more assertive in salary negotiations. Yada, yada.
But there is one reason that I think is more plausible than all the others: managers simply reward “disagreeable” behavior more, whether they know it or not. Doesn’t that sound like a law firm partner you may know?

Juliette Youngblood and Morgan Chu
Last month, Juliette Youngblood, an ex-partner at the elite California law firm of Irell & Manella, filed suit against her former firm. In her lawsuit for sex discrimination and wrongful termination, Youngblood advanced a whole host of salacious allegations — including a report of sexual harassment by Morgan Chu, arguably the nation’s #1 intellectual-property litigator.
Irell did not respond to the lawsuit at the time. Now it has, in a blistering 22-page filing that calls Youngblood’s claims “meritless” and “utterly false, complete fabrications manufactured out of whole cloth.”
What does the firm have to say about the specific claims made by Youngblood — such as the allegation that a drunken Morgan Chu made inappropriate and offensive comments to her at a firm happy hour, including remarks about her physical appearance and about “objects entering [Youngblood's] body”?
And what do ATL sources, including readers familiar with both Youngblood and Irell, think of the situation?

We shouldn’t be surprised that the American Bar Association barely cares about law schools misleading prospective law students when the organization doesn’t even really seem to mind when law school lie directly to the ABA itself. The Villanova Law LSAT scandal has been resolved, and boy are you going to be underwhelmed by the penalties associated with lying to the ABA for four years.
For those who haven’t been following along, an investigation revealed that former Villanova administration officials misrepresented the median LSAT scores and GPAs of incoming Villanova students. The deceit took place for many years. Investigators later found that Villanova also falsely reported the number of admission offers extended to Villanova applicants.
These are pretty serious findings against the school. You’d expect the punishment to be severe… unless you’ve actually been paying attention to how the ABA operates. If you are an ABA watcher, you know that this is an organization that thinks wrists are for slaps, not for cuffs.
Either way, all will find it amusing to listen to Villanova Law Dean John Gotanda try to explain how the meaningless sanction was only achieved because Villanova took the matter so seriously….

Madeline Layla Samaan-Fay, RIP
I think he did the right thing. I’m proud of my brother and now he’s in a better place. He’s at peace. His daughter’s at peace. She’ll have one name now, and we can move on. And hopefully the court will learn a little thing about justice.

Tyler Clementi and Dharun Ravi
As we mentioned in Friday’s Non-Sequiturs, the legal team of Dharun Ravi has moved to dismiss the criminal charges against Ravi stemming from the suicide of Tyler Clementi. As many of you know, Clementi committed suicide after Ravi streamed video of Clementi hooking up with another guy.
Lawyers to Dharun Ravi discovered comments from Clementi suggesting that Clementi was concerned about his parents’ reaction to his sexual orientation. Other Clementi messages are getting more headlines. According to New York Magazine, Clementi “also made jokes about Ravi’s family, calling them ‘sooo indian / first gen americanish…his rents defs owna dunkin [donuts].’ In other words, typical teen asshole gossip, on both sides.”
Typical is how I’ve been describing Ravi’s behavior from the very beginning. I didn’t need the system digging into the past of a suicide victim to determine whether his roommate “caused” him to take his own life.
But this is what many people wanted. So now that we’re here, I’m wondering if people are happy….

Ladies, admit it. Sometimes you dream of going back in time to the days where damsels in distress were rescued by swashbuckling romantics on noble steeds. But in today’s day and age, there seems to be a shortage of heroic knights. And that’s mostly because the crop of men with swords handy leave certain things to be desired — things like good looks, social skills, and the ability to refrain from speaking in Elvish.
But when we heard about Terry Lee Locy, a Florida lawyer educated at the University of Miami School of Law, we thought that maybe this self-described “popular young gentleman known for his quick wit and his athletic physique” could assist his sword-wielding brethren. After all, the last guy we wrote about who was into medieval attire and sharp objects has been accused of murder.
But alas, Terry Locy will be unable to act as the great redeemer for this generation’s battalion of renaissance men. Facing counts of aggravated assault with a deadly weapon and domestic violence battery, he could be sent to his kingdom’s dungeon for up to five years.
Why? Because he’s accused of challenging his girlfriend to a naked duel….

Stop me if this sounds familiar to you:
The managing partner of your firm tells you and your colleagues that you all need to “do more marketing.” What that vague phrase means is unclear, but the partner feels it’s imperative. It’s the only way to bring in more business. Someone — maybe even you — ventures to ask for ideas on what kind of marketing you all should be doing.
Your fearless leader looks nonplussed for a moment, then shakes his head quickly like a dog drying himself and sputters, “Network. Get out there and network.” Meeting over.
Now you and your colleagues are left trying to divine just how to go about “marketing” and “networking.” There were no courses on these arcane arts in your non-T14 law school. (Fear not: The T14 law schools didn’t have those courses either.)

You've got to be kidding me with this...
In mid-July, we wrote about Senator Chuck Grassley (R-IA) and his quest to get answers from the American Bar Association about the future of legal education in this country. Grassley’s inquiry came on the heels of a similar request from Senator Barbara Boxer (D-CA).
Steven Zack of the ABA responded quickly, making sure to pass a great deal of the blame off on the Section of Legal Education and Admissions to the Bar.
Grassley was apparently unimpressed with the response he received from the ABA, so last week he fired back with a shorter (and snarkier) list of questions.
Recall that Zack’s last response to Grassley touted that “no one could be more focused on the future of our next generation of lawyers than the ABA.” Will those be Zack’s famous last words in this debate?

Many prominent people, including Chief Justice John Roberts and Judge Harry Edwards, have raised their voices about the increasing irrelevance of academic writing to practicing lawyers and judges. Yet, despite railing at the academy, those judges — and law firms, and sophisticated purchasers of legal services — all rely on the academics to identify talented lawyers. Law schools brand the beef, and purchasers buy based on the brand. What do I mean, and why is that process natural and appropriate?
Let’s start with an example for people coming right out of law school: How should judges pick law clerks? One way — perhaps even the “fair” way — would be for judges to assume that each of the 45,000 people graduating from law school is equally likely to make a fine clerk. Judges would solicit applications from all 45,000 and then start the process of sorting the good from the bad.
That cannot work, of course. Judges don’t have the resources (or, necessarily, the ability) to study transcripts, read writing samples, conduct interviews, and do the other spadework needed to assess all of those candidates comprehensively. And judges can’t externalize the cost of the screening process; there’s no person or institution that would play that role for an acceptable price.
What are judges to do? They rely on law schools to brand the beef.
Rant as they may about scholars producing unhelpful scholarship, most judges rely essentially unthinkingly on those same scholars to have separated the potentially gifted lawyers from the crowd. Judges assume that the best students went to the best law schools; that, after arriving, the more talented law students outperformed the less talented ones; and thus that the best performers at the best law schools will make the best clerks. Judges typically pick their clerks from among the top graduates of the elite schools. Judges may think that professors are insane when they’re selecting topics for their scholarship and then devoting months to researching and writing on those subjects, but those same judges rely on the same professors to brand the beef astutely. Whatever criteria law schools are using within the asylum to rank their students, the outside world seems quite happy with it.

Larry Sager
Aren’t you supposed to get some kind of prize for moving your school into the top 14?
Lawrence Sager, dean of the University of Texas School of Law, will be stepping down at the end of the 2011-2012 academic year.
We’ve been a big fan of Dean Sager around these parts. He’s an NYU guy transplanted to Texas. And he managed to get Texas into the top 14 of the U.S. News law school rankings.
But all good things must come to an end. Why is Larry Sager relinquishing the UT Law deanship?
