Associate Bonus Watch: Kaye Scholer Tries to Confuse By Matching Cravath's Year-End Bonus and Last Year's Spring Bonus

SUBJECT: U.S. Associate Bonus Announcement

On behalf of the Partnership, we would like to thank our Associates for their commitment and dedication
to the Firm and our clients in 2011. We are therefore pleased to announce below the bonus amounts to be
paid on or before the week of January 23, 2012. These bonuses will be paid to associates in good
standing, in accordance with the guidelines outlined in the Associate Bonus Policy distributed on
November 16, 2010. As set forth in the policy, there will be two “Tiers” of bonus payments:

Tier 1: 1950 hours of which up to 150 hours may be pro bono, or a combination of pro bono and
firm citizenship hours (with firm citizenship hours capped at 50). 1800 hours must be billable.

Tier 2: 2400 hours of which up to 150 hours may be pro bono, or a combination of pro bono and
firm citizenship hours (with firm citizenship hours capped at 50). 2250 hours must be billable.
An associate who qualifies for a bonus will receive the total amount indicated for his or her class year
under the Tier for which he or she qualified.
