It's All Fun and Games Until a Fake Penis Gets You Fired

Here at Above the Law, it seems like we've got a running repository on all of the strange things that employees can do to be fired from their jobs. Here at Above the Law, it seems like we’ve got a running repository on all of the strange things that employees can do to be fired from their jobs. And whether it’s legal or illegal for an employer to do so, we love to report on these firings, because some of them are pretty hysterical.

For example, we mentioned in Morning Docket that a man claimed he was fired for his love of strippers and prostitutes. Hell, a law firm supposedly fired a receptionist for reporting to jury duty. As all of our readers know, one of Kasowitz Benson’s finest was allegedly fired for his “superior legal mind.”

And now, we have a story of a woman who was allegedly fired for wearing a fake penis to work….

So, how does one get fired for wearing a fake penis to work? The Philadelphia Daily News has all of the details:

A northeastern Pennsylvania woman is suing a South Jersey-based maker of frozen treats and other snack foods, claiming that she was wrongfully fired because she wore a prosthetic penis to work.

Pauline Davis, 45, wore the device to the J&J Snack Foods plant in Moosic, Lackawanna County, while she contemplated a gender change, according to a federal civil-rights complaint filed Wednesday in U.S. District Court in Scranton. She confided in several co-workers about the device, and someone told management, according to the complaint.

She subsequently was fired from her job as a packer/line inspector. Her termination, she claims, was discriminatory….

Here’s the best part: Davis claims that this was a discriminatory firing because one of her co-workers, a man who wore women’s clothing and prostheses, was neither fired nor disciplined for doing so. Double standard, much?

That being the case, you’ve really got to wonder why Davis was fired for wearing a prosthetic penis. It’s not as if she whipped out her faux schlong and showed it off to her co-workers. It’s not as if was so gargantuan, so John Holmesian in size, that it interfered with her ability to do her job.

What’s the lesson learned here?

Fake chicks with real dicks: good. Real chicks with fake dicks: bad.
