EDISCOVERY CORPORATE COUNSEL
The Electronic Discovery (eDiscovery) Corporate Counsel will be responsible for overseeing all aspects of discovery management at Gilead. The position will involve three primary areas of responsibility: (1) operational (management of Gilead’s Litigation Operations team; interacting with in-house and outside counsel as well as third-party service providers); (2) tactical (providing legal guidance to Gilead on eDiscovery issues); and (3) strategic (creating and implementing a vision to further Gilead’s e-Discovery function). The eDiscovery Corporate Counsel will be responsible for ensuring the quality, timeliness, and efficiency of all aspects of the discovery process across all matters.
The eDiscovery Corporate Counsel will serve as the primary liaison between Legal and other business units for the purposes of coordinating and preparing for discovery in litigations and investigations. This position will also represent the Litigation Operations group to the executive team.
The eDiscovery Corporate Counsel will be a thought leader to the organization for all discovery management issues, able to communicate the requirements and strategy of the discovery process internally and externally, and lead the development of more mature discovery practices.

Essential Duties and Job Functions:
• Manage internal Litigation Operations team responsible for day-to-day discovery management, ensuring productivity, quality, and deadline compliance
• Serve as primary liaison between Legal and business units for all discovery related initiatives and matters
• Manage the evaluation, selection, negotiation, and ongoing relationships of third party vendors in support of discovery
• Assess, enhance, develop, and document discovery policies and procedures
• Advise on the latest developments in discovery rules and case law, with special emphasis on developments in eDiscovery
• Coordinate with Records Management and IT Managers to align discovery and investigative practices with Records Management and IT best practices where appropriate
• Develop legal hold policies and litigation readiness strategies
• Counsel on best practices for preserving, collecting, and producing hard copy documents and electronic information
• Design and lead discovery process improvement initiatives
• Serve as a 30(b)(6) witness and / or participate in Rule 26(f) “meet and confer” sessions as required.
Required Knowledge, Experience and Skills:
• Requires a Juris Doctorate or equivalent advanced degree
• Minimum of 6 years of experience in eDiscovery and litigation support industry, including preferably managing a Discovery team/department at a major corporation or law firm
• Previous experience should include leading multiple, simultaneous eDiscovery projects spanning the full Electronic Discovery Reference Model (EDRM) including legal hold, collections, computer forensics, processing and production
• Knowledge of eDiscovery and computer forensics hardware and software
• Experience with data processing/culling technologies, Early Case Assessment tools, and hosted document review solutions including kCura Relativity and other electronic review platforms
• Experience in the collections and analysis of a wide range of data sources including MS Exchange/Outlook, SharePoint, file shares, archiving systems (e.g., Enterprise Vault), backup systems, and mobile devices
• In-depth knowledge of the Federal Rules of Evidence and Federal Rules of Civil Procedure
• Excellent interpersonal and verbal and written communications skills; capable of conducting training and and providing consultation to the executive team
• Strong negotiation skills
• Ability to assess current policies and practices and recommend process improvements
• Ability to work independently and collaboratively
• Detail-oriented and organized
• Experience in the biotechnology and/or pharmaceutical industry preferred
