In the wake of Ku’s suit, Mitchell departed the deanship — but his contract with Case Western to serve as dean presumably contained provisions relating to real estate, as contracts for prominent professors and law school deans often do, as well as a specified length of his term as dean. To avoid fighting with Mitchell over his contract, which perhaps got terminated prematurely, the university agreed to take the Cleveland house off his hands.
