This Kid’s Supreme Court Quiz Answer Probably Not Getting Credit

A student's test answer flunks on a key Supreme Court fact.

When the question asks you to “name as many current Supreme Court justices as you can,” does Justice Scalia count? He’s not so “current” anymore. That said, I’m sure this exam was prepared in advance of Justice Scalia’s death — wouldn’t Justice Scalia have wanted us to apply the original intent of the test’s framers?

So maybe Scalia should count. And the kid shows applied knowledge by recognizing that he’s passed. On the other hand, there may be a significant gap in his or her grasp of the material…
