An Important Legal Victory For Transgender Folk

Rainbow_flag_and_blue_skiesThere was no evidence before the trial court to authorize a conclusion that either of them were acting with any improper motive. The court is directed on remand to enter an order changing petitioners’ names.

—Georgia Court of Appeals Judge Elizabeth Branch, writing for a unanimous panel overturning a lower-court decision that barred two transgender men’s applications for a name change. Though the petitions were uncontested, an Augusta judge, J. David Roper, blocked the name changes, saying their new names would be “a type of fraud on the general public” and “offend the sensibilities and mores of a substantial portion of the citizens.” Fortunately the Court of Appeals disagreed.
