Seeking Your Perspective On Litigation Finance

The practice is growing at an astounding rate.

In recent years, litigation finance has undergone explosive growth and increasingly broad acceptance, overcoming the many misconceptions that dogged its introduction to the U.S. legal industry. Annually, litigation funding grew at an astounding rate of about 40 percent between 2012 and 2106, and future projections are correspondingly sunny. Driving this momentum is a combination of favorable legal and regulatory developments and the impressive returns being achieved by litigation financiers.

We conducted our first survey of practicing lawyers regarding litigation finance back in 2016. Today, we continue to explore the perspective of practicing litigators and their in-house peers in order to better understand the dynamics of this rapidly growly phenomenon. Our brief survey seeks insight into such questions as:

• Who was the main driver of the decision to seek litigation financing — the client or outside counsel?
• What was the strongest motivation for doing so?
• How does adoption vary among industries?
• What are the major obstacles to adoption?

In addition, respondents are invited to share their experiences with or perception of specific litigation finance firms.
