Biglaw Firm's Staggering Work On Behalf Of A Porn Studio

That's a lot of lawsuits, even for a Biglaw firm.

The Biglaw firm of Fox Rothschild has been very busy, filing an astonishing 448 copyright lawsuits in the third quarter of 2018. According to data collected by Lex Machina and reported by Law360, the majority of those lawsuits have been illegal downloading cases filed on behalf of the adult film studio, Strike 3 Holdings. In fact, the firm has filed the most copyright cases in each of the last four quarters, usually with Strike 3 as their client.

As you might imagine, it is unusual to see a respected Biglaw firm top the list of attorneys filing copyright lawsuits, which are overwhelmingly suits against John Doe porn downloaders. This is particularly true after the scandal surrounding notorious porn troll, Prenda Law. The founder of that law firm pleaded guilty to a massive extortion scheme based on mass-filed copyright cases. And that case has hung over the work Fox Rothschild is doing:

In June, a Seattle federal judge asked Fox Rothschild attorneys why they shouldn’t face sanctions over their conduct in one Strike 3 case. The attorneys responded by addressing “the elephant in the room,” saying Strike Three is “the anti-Prenda” and that the company does not have a “litigation business model.”

Still, the number of cases Strike 3 has filed in 2018 — 1,653 to be exact — has been staggering (the company has used Fox Rothschild as well as smaller firms as counsel in these suits). And it’s a far cry from the 228 lawsuits they filed in 2017.
