Does Judge Gorsuch Have Backwards Thoughts On Working Women And Pregnancy?

Will this come up in the confirmation hearings?

Judge Gorsuch outlined how law firms, and companies in general, had to ask female interviewees about pregnancy plans in order to protect the company…. Judge Gorsuch told the class that not only could a future employer ask female interviewees about their pregnancy and family plans, companies must ask females about family and pregnancy to protect the company. Judge Gorsuch tied this back to his original comment that companies need to ask these question in order to protect themselves against the female employees.

—Jennifer Sisk, a lawyer in Colorado who took a class with Neil Gorsuch in the spring semester 2016, writing a letter to the Senate Judiciary Committee about comments the judge supposedly made in class. The letter was published yesterday by the National Employment Lawyers Association and the National Women’s Law Center.

It is possible that in a classroom setting, the comments could have been made in an effort to play devil’s advocate and spark discussion; however, Sisk indicated she thought the information was pertinent so the committee could delve into the issue during Judge Gorsuch’s confirmation hearing.

Another student in the class, Will Hauptman, disputes Sisk’s account. Eleven female former Gorsuch clerks for Gorsuch have also submitted a letter to the committee in his support.
